ORDINANCE NO. 190108

 

Approving the plat of 25th and Troost Development, an addition in Jackson County, Missouri, on approximately 4.43 acres generally located between E. 25th Street and E. 26th Street and Troost Avenue and Forest Avenue, creating 1 lot for the purpose of constructing 248 residential units; releasing various easements; vacating a portion of alleyways; authorizing the Director of City Planning and Development to execute and/or accept certain agreements; and directing the City Clerk to record this ordinance and attached documents. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of 25th and Troost Development, a subdivision in Jackson County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference, is hereby approved.

 

Section 2. That all right, title and interest in the following recorded easements be and the same are hereby released to the respective owners, their successors or assigns, over that part of aforesaid easement under the following, this release does not become effective until the final plat is recorded:

Section 3. That the portion of north/south alleyway (between E. 25th Street and E. 26th Street) and the portion of east/west alleyway (between Troost Avenue and Forest Avenue) which are identified on the plat as alleys “to be vacated by this plat,” are hereby vacated because the Council finds that no private rights will be unreasonably injured or endangered by these vacations and that the public will suffer no unreasonable loss or inconvenience thereby. There are utilities that wish to retain an easement over the portion of the vacated north/south alleyway. These vacations do not become effective until the final plat is recorded.

Section 4. That the Director of City Planning and Development is hereby authorized to execute and/or accept any and all agreements necessary to clear the title of any right of way, utility easements or other public property dedicated on the plat.

 

Section 5. That the City Clerk is hereby directed to record copies of this ordinance, together with the documents described herein and all other relevant documents, when the Developer has met all of the requirements for the plat to be released for recording, in the Office of the Recorder of Deeds of Jackson County, Missouri.

 

Section 6. That the Council finds that the City Plan Commission has duly recommended its approval of this plat on December 18, 2018.
