COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 070242

 

Approving the preliminary plat of Tiffany Springs Market Center West Detention Facility on a 1.43 acre tract of land generally located at the southwest corner of N.W. Skyview Avenue and N.W. Tiffany Springs Road. (SD 1316)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Tiffany Springs Market Center West Detention Facility on a 1.43 acre tract of land generally located at the southwest corner of N.W. Skyview Avenue and N.W. Tiffany Springs Road, and more specifically described as follows:

 

A subdivision of land in the Northeast Quarter and the Southeast Quarter of Section 1, Township 51 North, Range 34 West and the Southwest Quarter of Section 6, Township 51 North, Range 33 West, in Kansas City, Platte County, Missouri being described as follows; Beginning at the Northeast Corner of said Southeast Quarter; being the Northwest corner of said Southwest Quarter; thence South 885640 East along the North line of said Southwest Quarter 11.58 feet to the West Right-of-Way line of Missouri Route W (also known NW. Tiffany Springs Road) as now established, thence South 72124 West along said West Right-of-Way line, 164.55 feet to the East Right-of-way line of Interstate Route 29 as now established; thence South 635511 West along said East Right-of-Way line 217.45 feet; thence North 302947 West, along said East Right-of-Way line 284.53 feet; thence North 81 16' 39" East 25.99 feet; thence Easterly along a curve to the right, tangent to the last described course, having a radius of 1091.00 feet, a central angle of 09 46' 42", an arc distance of 186.19 feet; thence South 88 56' 40" East, 137.97 feet to the Point of Beginning. Containing 1.43 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro "overall" storm drainage study for the entire Tiffany Springs Market Center development to Development Services for review and acceptance at the time the first plat is submitted, with a micro "detailed" storm drainage study to be submitted for this plat at the time of final platting, and that the developer construct any necessary improvements as required by Development Services.

 

3. That the developer dedicate additional right of way for a secondary arterial as required by Development Services so as to provide a minimum of 40 feet of right of way as measured from the centerline of N.W. Tiffany Springs Road.

 

4. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

5. That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer be responsible for all costs associated with subordination activities.

 

6. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

7. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

8. That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
