ORDINANCE NO. 140582

 

Approving a development plan in District M 1-5 on about 48 acres generally located south of Missouri State Highway 150 and east of Botts Road. (14049-P-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan is hereby approved in Zoning District M 1-5 (Manufacturing 1-5) to allow for an industrial development for two industrial buildings on two proposed lots generally located south of Missouri State Highway 150 and east of Botts Road, and more specifically described as follows:

 

That portion of the following described real property lying above the top of the Winterset ledge of limestone rock: A tract of land in the Northwest Quarter and Northeast Quarter of Section 35, Township 47 North, Range 33 West of the 5th Principal Meridian in Kansas City, Jackson County, Missouri being bounded and described as follows: Commencing at the Northwest corner of said Northwest Quarter; thence South 03 degrees 35 minutes 11 seconds West, along the West line of said Northwest Quarter, 1992.63 feet; thence South 86 degrees 24 minutes 49 seconds East, 444.98 feet to the Point of Beginning of the tract of land to be herein described, said point being on the Northeasterly right of way line of Botts Road as established by Special Warranty Deed recorded November 10, 2008 as Document No. 2008E0117523: thence North 66 degrees 53 minutes 23 seconds East, 689.63 feet; thence North 60 degrees 33 minutes 04 seconds East, 627.59 feet; thence North 67 degrees 05 minutes 52 seconds East, 1,513.98 feet; thence Northeasterly along a curve to the left being tangent to the last described course with a radius of 424.00 feet, a central angle of 38 degrees 34 minutes 22 seconds and an arc distance of 285.45 feet; thence North 28 degrees 31 minutes 30 seconds East, 91.20 feet to a point on the Westerly right of way line of Andrews Road as established by Special Warranty Deed recorded November 10, 2008, as Document No. 2008E0117522; thence South 03 degrees 41 minutes 03 seconds West, along said Westerly right of way line, 156.58 feet; thence Southerly along said Westerly right of way line, along a curve to the right being tangent to the last described course with a radius of 965.00 feet, a central angle of 03 degrees 57 minutes 51 seconds and an arc distance of 66.77 feet; thence South 07 degrees 38 minutes 54 seconds West, along said Westerly right of way line, 638.55 feet; thence Southwesterly along said Westerly right of way line, along a curve to the right being tangent to the last described course with a radius of 465.00 feet, a central angle of 63 degrees 48 minutes 16 seconds and an arc distance of 517.82 feet; thence South 71°27'11" West, along the Northerly right of way line of said Andrews Road, 2,054.73 feet; thence Southwesterly along said Northerly right of way line, along a curve to the left being tangent to the last described course with a radius of 535.00 feet, a central angle of 11 degrees 54 minutes 48 seconds and an arc distance of 111.24 feet; thence South 59 degrees 32 minutes 22 seconds West, along said Northerly right of way line, 24.35 feet; thence Westerly and Northwesterly along said Northerly right of way line, and along the Northeasterly right of way line of Botts Road as established by Special Warranty Deed recorded November 10, 2008 as Document No. 2008E0117663, along a curve to the right being tangent to the last described course with a radius of 56.00 feet, a central angle of 90 degrees 00 minutes 00 seconds and an arc distance of 87.96 feet; thence North 30 degrees 27 minutes 38 seconds West, along the Northeasterly right of way line of said Botts Road as established by said Document No. 2008E0117663, and by aforesaid Document No. 2008E0117523, 278.28 feet; thence Northwesterly along said Northeasterly right of way line as established by said Document No. 2008E0117523, along a curve to the right being tangent to the last described course with a radius of 1,960.00 feet, a central angle of 07 degrees 33 minutes 30 seconds and an arc distance of 258.55 feet; thence North 22 degrees 54 minutes 08 seconds West, along said Northeasterly right of way line as established by said Document No. 2008E0117523, 20.88 feet to the Point of Beginning. Containing 2,066,782 square feet or 47.447 acres, more or less.

Section B. That the development plan for the area legally described above which is hereby approved is subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended.

 

2. That the developer submit a detailed micro storm drainage study showing compliance with the approved and most current macro study on file with the City and with current adopted standards in effect at the time of submission, including a detailed analysis and design of the permanent Water Quantity and Quality BMP's, conveyance systems, and sewer services, prior to approval and issuance of any building permits to construct improvements on the site; that the developer verify and/or improve downstream conveyance systems or address solutions for impacted properties due to flow contributions from the site; and that the developer construct any other improvements as required by the Land Development Division as necessary to mitigate impacts from rate, volume, and quality of runoff from each proposed phase.

 

3. That the developer grant on City approved forms, BMP Easements to the City, as required by Chapter 88 and the Land Development Division, prior to issuance of any building permits or bmp permits, whichever occurs first.

 

4. That the developer obtain permits to construct a sidewalk along the north/west side of Andrews Road, prior to temporary or final Certificate of Occupancy, as required by the Land Development Division.

 

5. That the developer submit a letter to the Land Development Division from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, to identify sidewalks, curbs, and gutters in disrepair as defined by Public Works Department's "OUT OF REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB revised 4/8/09" and based on compliance with Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters where said letter shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed to remedy deficiencies and/or to remove existing approaches no longer needed by this project. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Land Development Division and prior to issuance of any certificate of occupancy permits including temporary certificate occupancy permits.

 

6. That the developer pay impact fees as required by Chapter 39 of the City's Code of Ordinances as required by the Land Development Division.

 

7. That the developer obtain the executed and recorded City approved grading, temporary construction, drainage/sewer, or any other necessary easements from the abutting property owner(s) that may be required prior to submitting any public improvements crossing properties not controlled by the developer and include said document(s) within the public improvement applications submitted for permitting.

 

8. That the owner/developer submit plans for grading, siltation, and erosion control to the Land Development Division for review, acceptance, and permitting for any proposed disturbance area equal to one acre or more prior to beginning any construction activities.

 

9. That the owner/developer secure a side Disturbance permit from the Land Development Division prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity.

 

10. That the developer verify sight distance for the Andrews Road drive connection improvements to ensure local jurisdiction and/or minimum AASHTO adequate sight distance standards are met.

 

11. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

12. That the developer secure the approval of the Missouri Highway and Transportation Department for any work within State right of way.

 

13. That the developer install a traffic signal at the intersection of Botts Road and 149th Street at such time that the Public Works Department determines that traffic signal warrants are met.  

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
