ORDINANCE NO. 000333

Approving a Community Unit Project on an approximately 38.75 acre tract of land generally located on the west side of the 9200 block of Noland Road, approximately 2000 feet north of Bannister Road. (12390-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 38.75 acre tract of land generally located on the west side of the 9200 block of Noland Road, approximately 2000 feet north of Bannister Road, and more specifically described as follows:

 

That part of the Northeast Quarter of Section 27 and the Northwest Quarter of Section 26, all in Township 48 North, Range 32 West, Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the common section corner of Sections 22, 23, 26 and 27, Township 48 North, Range 32 West; thence South 02E27'56" West along the east line of the Northeast Quarter of said Section 27, a distance of 1006.06 feet; thence South 12E02'18" East, a distance of 137.15 feet to the point of beginning, thence South 73E49'51" East, a distance of 244.07 feet; thence North 75E08'26" East, a distance of 163.89 feet; thence North 31E47'45" East, a distance of 174.91 feet; thence North 66E51'35" East, a distance of 40.00 feet to a point 10.00 feet west of the westerly right of way line of Noland Road as now established; thence along a line parallel and 10.00 feet west of said westerly right of way line and along a non-tangent curve to the right having a radius of 2814.79 feet, a central angle of 26E36'02", the radius point bears South 66E51'35" East, thence southerly along the arc of that curve, a distance of 1306.81 feet; thence continuing along a line parallel to and 10.00 feet west of said westerly right of way line South 03E08'27" West, a distance of 165.95 feet to a point on the south line of Lot 37 in Unity Ridge and Gardens, a subdivision in said city, county and state; thence South 86E43'26" West along the south line of said Lot 37, a distance of 751.70 feet; thence North 20E54'12" West, a distance of 268.98 feet; thence North 39E48'59" West, a distance of 304.89 feet; thence North 78E53'19" West, a distance of 333.40 feet; thence South 79E01'05" West, a distance of 185.30 feet; thence South 89E49'29" West, a distance of 578.63 feet to a point on the west line of the East Half of the Northeast Quarter of said Section 27; thence North 02E19'11" East, along the west line of the East Half of the Northeast Quarter of said Section 27, a distance of 405.72 feet; thence North 87E43'34" East, a distance of 391.80 feet; thence North 58E24'27" East, a distance of 299.14 feet; thence South 11E34'54" East, a distance of 140.46 feet; thence South 29E02'29" East, a distance of 126.06 feet; thence South 71E06'22" East, a distance of 141.32 feet; thence North 64E41'16" East, a distance of 178.61 feet; thence North 39E39'56" East, a distance of 111.12 feet; thence North 11E48'43" East, a distance of 208.05 feet; thence North 19E26'18" East, a distance of 419.23 feet; thence South 84E51'59" East, a distance of 51.18 feet; thence South 12E02'18" East, a distance of 211.40 feet to the point of beginning and containing 38.75 acres, more or less.

 


is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for Noland Road as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of Noland Road.

 

7. That the developer construct sidewalks and install streetlights on the west side of Noland Road as required by the Department of Public Works.

 

8. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of the private open space with the final plat.

 

9. That a waiver to Section 66-83(f) of the Subdivision Regulations is hereby granted to allow construction of sidewalks on only one side of the internal streets as indicated on the Community Unit Project plan.

 

10. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

11. That the developer extend water mains as required by the Water Services Department.

 

12. That the developer submit a street tree planting plan as part of the final plat, secure the approval of the City Forester for street trees planted on right of way in front of residential lots with a copy to be submitted to the Department of City Development and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

13. That the developer submit a street name signage plan to the Street Naming Committee for approval.

 

14. That the developer extend sanitary sewers as required by the Department of Public Works.

 

15. That the developer secure the approval of the Board of Zoning Adjustment for any proposed subdivision identifications signs prior to the issuance of a sign permit.

 

16. That the developer submit a final plan to the City Plan Commission for approval for all private open space areas, including plans for pedestrian pathways, landscaping, grading, screening, berming, fencing and private park development.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 000333, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
