COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 031004

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0510, rezoning an area of approximately 50.6 acres generally located 1000 feet north of N.W. Tiffany Springs Road, on the east side of N.W. Skyview Avenue from Districts GP-3 (Regional Business), GP-4 (High Density Residential) and GP-6 (Low Density Residential) to District GP-4 (High Density Residential). (9831-GP-10)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0510, rezoning an area of approximately 50.6 acres generally located 1000 feet north of N.W. Tiffany Springs Road, on the east side of N.W. Skyview Avenue from Districts GP-3 (Regional Business), GP-4 (High Density Residential) and GP-6 (Low Density Residential) to District GP-4 (High Density Residential), said section to read as follows:

 

Section 80-11A0510. That an area legally described as:

 

All that part of the North Half of Section 6, Township 51, Range 33, in Kansas City, Platte County, Missouri, described as follows: Commencing at the southeast corner of the Northwest Quarter of said Section 6; thence North 89E00'29" West along the south line of the Northeast Quarter of said Section 6, a distance of 127.04 feet; thence North 0E59'31" East, a distance of 361.86 feet to the point of beginning of the tract of land herein to be described; thence northerly and westerly on a curve to the left having an initial tangent bearing of North 18E22'42" West and a radius of 1091.00 feet, an arc distance of 1724.64 feet; thence South 71E02'57" West, a distance of 131.66 feet; thence westerly on a curve to the right being tangent to the last described course and having a radius of 1091.00 feet, an arc distance of 614.18 feet to the easterly right-of-way line of N.W. Skyview Drive; thence North 23E49'39" East along the easterly right-of-way line of said N.W. Skyview Drive, a distance of 210.86 feet; thence South 66E10'21" East along the easterly right-of-way line of said N.W. Skyview Drive, a distance of 5.00 feet; thence North 23E49'39" East along the easterly right-of-way line of said N.W. Skyview Drive, a distance of 400.00 feet; thence South 66E10'21" East along the easterly right-of-way line of said N.W. Skyview Drive, a distance of 10.00 feet; thence North 23E49'39" East along the easterly right-of-way line of said N.W. Skyview Drive, a distance of 100.00 feet; thence North 66E10'12" West along the easterly right-of-way line of said N.W. Skyview Drive, a distance of 15.00 feet; thence North 23E49'39" East along the easterly right-of-way line of said N.W. Said tract of land contains 50.60 acres more or less.

 

is hereby rezoned from Districts GP-3 (Regional Business), GP-4 (High Density Residential) and GP-6 (Low Density Residential) to District GP-4 (High Density Residential), all as shown outlined on a map marked Section 80-11A0510, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a street name sign plan for the entire development for approval by the Street Naming Committee prior to submittal of the first final plat.

 

3. That the developer submit an overall storm drainage study to the City Engineers Office for approval for the entire development at the time the first final plat is submitted, with detailed storm drainage studies to be submitted for each phase of development at the time of final platting, and that the developer make any improvements as required by the City Engineers Office.

 

4. That the developer dedicate additional right of way for N.W. Skyview Avenue as required by the Department of Public Works so as to provide 56 feet of right of way as measured from the centerline of N.W. Skyview Avenue.

 

5. That the developer construct an southbound left turn lane on N.W. Skyview Avenue at the proposed development entrance (as shown on the preliminary plan) with storage of 200 feet in length and proper tapers as required by the Department of Public Works.

6. That the developer dedicate additional right of way for N. Ambassador Drive as required by the Department of Public Works so as to provide 56 feet of right of way as measured from the centerline of N Ambassador Drive.

 

7. That the developer construct the northern/eastern half of N. Ambassador Drive to primary arterial street standards as required by the Department of Public Works, including construction of curbs, gutter, and sidewalks, and installation of streetlights.

 

8. That the developer agree to dedicate up to one acre of undeveloped green space not planned for buildings or parking in the southwestern corner of Tract G as shown on the development plan for additional right of way for the intersection of N Ambassador Drive and NW Skyview Avenue as such time as the intersection alignment is approved in accordance with the KCI Corridor Tax Increment Financing Plan.

 

9. That the developer construct a six-foot wide sidewalk in the existing right of way for N.W. 96th Terrace as required by the Department of Public Works.

 

10. That the developer design and construct all interior streets to City standards as required by the Department of Public Works, including curb and gutter, storm sewers, street lights, sidewalks, grade modifications resulting in reconstruction of existing road section to meet vertical and horizontal alignment standards, and private utility relocations to outside the right-of-way.

 

11. That the developer provide adequate sight distance at all proposed subdivision entrances from N.W. Skyview Avenue and N. Ambassador Drive as required by the Department of Public Works.

 

12. That the developer construct sidewalks along the frontage of all homeowner association tracts (pools, tracts, etc.) and all double-fronted lots prior to recording of a final plat containing any of the aforementioned parcels.

 

13. That temporary off-site cul-de-sacs be constructed as required by the Department of Public Works.

 

14. That any relocated street lights be integrated into existing street light system as required by the City Engineers Office.

 

15. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

16. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.

 

17. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

18. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area of the entire development exceeds one acre.

 

19. That the developer obtain a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities in the floodplain.

 

20. That the developer extend sanitary and storm sewers and determine adequacy as required by the Department of Public Works and Water Services Department.

 

21. That the developer extend or enlarge water mains and provide easements as required by the Water Services Department.

 

22. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

23. That the developer grant a Noise and Aviation Easement to the City.

 

24. That the developer comply with the Kansas City International Airport height regulations as required by the City.

 

25. That the developer contribute $79,837.24 in lieu of parkland dedication in satisfaction of Section 66-128 of the Subdivision Regulations. Calculation based on: [(584 units X 2.0 persons per multi-family unit) X 0.006 acres per person] X $11,389.05 = $79,837.24.

 

26. That the developer submit a street tree planting plan as part of all final plats and secure the approval of the City Forester for street trees planted on right of way in front of residential lots, with a copy to be submitted to the Department of City Development. The plan shall include size, type, species and placement of trees. The developer shall agree to plant in accordance with the plan approved by the City Forester.

 

27. That the developer submit a final plan to the City Plan Commission for approval prior to construction of all apartment buildings, covered parking structures, townhouses and community facilities, including detailed information on grading, landscaping, lighting (including a photometric study), signage (including elevations), and building elevations (with material palette).

A copy of said development plan is on file in the office of the City Clerk under Document No. 031004, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
