RESOLUTION NO. 941076

 

Approving an amendment to the South Development Area Plan in particular for that portion of the plan area bounded by Bannister Road on the north, I-435 on the south, U.S. 71 Highway on the east, and the eastern boundary of Blue River Parkway on the west and directing the City Clerk to file same.

 

WHEREAS, by Committee Substitute for Ordinance No. 38861, passed January 15, 1971, the City adopted the South Development Area Plan as a guide for development and redevelopment of that area located between 85th Street and the Cass County line and between State Line Road and the Lee's Summit-Kansas City corporate boundary; and

 

WHEREAS, said plan has been amended by Resolution Nos. 62713 and 62808 and further amended by Resolution No. 930894; and

 

WHEREAS, said plan was further amended by Resolution No. 940780, adopted July 14, 1994; and

 

WHEREAS, due to certain changes, it has been determined that certain modifications are appropriate to the land use plan and residential density standards for that area generally bounded by Bannister Road on the north, I-435 on the south, U.S. 71 Highway on the east, and the eastern boundary of Blue River Parkway on the west; and

 

WHEREAS, such modifications have been incorporated into an amendment to the South Development Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the South Development Area Plan as approved by Committee Substitute for Ordinance No. 38861, passed January 15, 1971, and as further amended by Resolution Nos. 62713, 62808, 930894 and 940780, is hereby amended to adopt a new land use plan and new residential density standards for that area generally bounded by Bannister Road on the north, I-435 on the south, U.S. 71 Highway on the east, and the eastern boundary of Blue River Parkway on the west with the plan and residential density standards attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove all public notices and hearings required have been given and had.

 

Section C. That the City Clerk is hereby authorized and directed to file a certified copy of these amendments to the South Development Area Plan in the office of the Department of Records for Jackson County, pursuant to Section 89.400, Revised Statutes of Missouri, 1986, as amended.
