ORDINANCE NO. 110149

Authorizing the Director of Parks and Recreation to enter into a supplemental cooperative funding agreement with the Missouri Department of Transportation for construction of the segment of the Brush Creek Trail enhancement, Project STP-3301(423).

WHEREAS, on November 16, 2009, the City and the Missouri Highway Commission previously entered into a Transportation Enhancement Funds Agreement as to public improvements designated as Brush Creek Trail, Prospect Avenue to Lake of the Enshriners, for the construction of a bicycle/pedestrian trail, (hereinafter, "Original Agreement"); and

WHEREAS, the Commission and the City now desire to revise the Original Agreement; and

WHEREAS, the supplemental agreement revises the authorization to advertize, date; and

WHEREAS, the trail connector provides shared use bicycle and pedestrian facilities and will provide a connection to segments of Brush Creek Trail already constructed in Kansas City; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF KANSAS CITY:

Section 1. That the Director of Parks and Recreation is authorized to execute a Supplemental Agreement with the Missouri Highways and Transportation Commission for the purpose of constructing a segment of the Brush Creek Trail from Prospect Avenue to Lake of the Enshriners. The agreement, in substantial form, is on file in the Office of the Director of Parks and Recreation.
