ORDINANCE NO. 100259
Annexing approximately 7.54 acres
generally located on the west side of Missouri Route 1 (N. Indiana Avenue) and
the east side of N. Agnes Avenue, extending approximately 840 feet south of the
City of Kansas City limits on N. Walrond Avenue, and directing the City Clerk
to file certified copies of this ordinance with the required Clay County
officials (100-AN-9).
WHEREAS, Parkway Holdings, LLC is developing property located on the west
side of Missouri Route 1 (N. Indiana Avenue) and the east side of N. Agnes
Avenue, the majority of which is located in Kansas City, but a small portion is
currently located within the City of Gladstone; and
WHEREAS, this action will allow the single family zoned parcel currently
located within Gladstone city limits to be expanded into Kansas City, and also
to allow all of Parkway Holdings property to be developed within one
municipality and deriving all municipal services from one municipality; and
WHEREAS, the City of Kansas City and the City of Gladstone agree that
services to the small portion of both properties not located within Kansas City
would be more efficiently served by Kansas City; and
WHEREAS, the property to be concurrently annexed by Kansas City and
detached by Gladstone abuts Kansas City; and
WHEREAS, the
developer of Parkway Village consents to this concurrent detachment and
annexation; and
WHEREAS, all provisions of Section 71.011, Revised Statutes of Missouri,
authorizing such concurrent detachment and annexation have been met; NOW,
THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. Annexation and Detachment of Property. That the following
property, generally located on the west side of Missouri Route 1 (N. Indiana
Avenue) and the east side of N. Agnes Avenue, extending approximately 840 feet
south of the City of Kansas City limits on N. Walrond Avenue, and more
specifically described as:

tract of land in the Northwest Quarter of Section 18, Township 51 North, Range
32 West of the 5th Principal Meridian in Gladstone, Clay County, Missouri,
being bounded and described as follows: Commencing at the Northeast corner of
the Northwest Quarter of said Section 18; thence South 00 degrees 21 minutes 49
seconds West, along the East line of said Northwest Quarter 1,801.20 feet to a
point on the North line of the Gladstone City Limits; thence North 89 degrees 19
minutes 31 seconds West, along said North line, 268.44 feet to a point on the
Westerly right-of-way line of Missouri State Route M-1, as now established,
said point being the Point of Beginning of the tract of land to be herein
described; thence South 14 degrees 12 minutes 41 seconds West, along said
right-of-way line, 206.78 feet; thence South 22 degrees 33 minutes 49 seconds West,
continuing along said right-of-way line, 195.71 feet; thence South 25 degrees 53
minutes 28 seconds West, continuing along said right-of-way line, 340.30 feet;
thence South 34 degrees 20 minutes 39 seconds West, continuing along said
right-of-way line, 146.18 feet; thence South 32 degrees 01 minutes 47 seconds West,
continuing along said right-of-way line, 26.32 feet to a point on the West line
of the Southeast Quarter of the Southeast Quarter of said Northwest Quarter;
thence North 00 degrees 20 minutes 24 seconds East, along said West line,
113.86 feet; thence North 53 degrees 18 minutes 05 seconds West, 57.34 feet;
thence North 37 degrees 56 minutes 34 seconds West, 100.50 feet; thence North
41 degrees 17 minutes 38 seconds West, 74.98 feet; thence North 23 degrees 47
minutes 17 seconds West, 100.40 feet; thence North 16 degrees 21 minutes 17
seconds West, 100.08 feet; thence North 01 degrees 56 minutes 46 seconds West,
104.40 feet; thence North 12 degrees 56 minutes 05 seconds West, 100.50 feet;
thence North 27 degrees 54 minutes 40 seconds West, 110.45 feet; thence North
89 degrees 59 minutes 24 seconds West, 51.41 feet; thence North 23 degrees 18
minutes 59 seconds East, 8.45 feet; thence North 09 degrees 59 minutes 01
seconds West, 60.59 feet to a point on the North line of said Gladstone City
Limits; thence South 89 degrees 19 minutes 31 seconds East, along said North
line, 732.50 feet to the Point of Beginning. Containing 328,401 square feet or
7.54 acres, more or less.
is hereby
declared to be annexed by the City of Kansas City effective upon the
simultaneous and concurrent detachment of this property by the City of Gladstone.
Section 2. Reason and Purpose for the Detachment and Annexation. That
this concurrent annexation by the City of Kansas City and the detachment by
Gladstone will allow Kansas City to provide services to the property and not
require two municipalities to provide services to one area, and it will place
all of N. Walrond Avenue within the city limits of Kansas City, thus benefiting
the citizens of both municipalities.
Section 3. Filing.
That the City Clerk will file a certified copy of this ordinance and a
certified copy of the related detachment ordinance adopted by the City of
Gladstone in the office of the County Clerk of Clay County, the Recorder of
Deeds of Clay County, and the Clerk of the Circuit Court of Clay County.
