ORDINANCE NO. 021321
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0448,
rezoning an area of approximately .77 acres generally located at the northwest
corner of Sni-A-Bar Road and Blue Ridge Cutoff from District C-2 (Local Retail
Business) to District PD/C-2 (Planned Districts/Local Retail Business), and
approving a development plan for the same. (4896-PD-10)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
commonly known as the Zoning Ordinance, is hereby amended by enacting a new
section to be known as Section 80-11A0448, rezoning an area of approximately
.77 acres generally located at the northwest corner of Sni-A-Bar Road and Blue
Ridge Cutoff from District C-2 (Local Retail Business) to District PD/C-2
(Planned Districts/Local Retail Business), said section to read as follows:
Section
80-11A0448. That an area legally described as:
TRACT 1: All that part of Lot 2, Subdivision of
William Lane Estate, a subdivision in Kansas City, Jackson County, Missouri,
described as follows: Commencing at the intersection of the northerly right of
way line of Sni-A-Bar Road Cutoff, as established by the deed filed February 9,
1932 as Document No. 305282, recorded in Book 572, page 498, in the office of
the Recorder of Deeds for Jackson County, Missouri, and the west line of said
Lot 2; thence due north along the west line of said Lot 2, a distance of 221.29
feet; thence due east, a distance 222.17 feet, to a point on the westerly right
of way line of Blue Ridge Cutoff, as established by deed filed March 10, 1932,
as Document No. 306301, recorded in Book 571, page 618, in said Recorders
Office; thence South 23E12'20" West, 173.47
feet, to a point 40 feet opposite centerline Station 102+33, of said Blue Ridge
Cutoff; thence South 55E07'39" West, along
the northwesterly right of way of said Blue Ridge Cutoff, a distance of 101.85
feet, to the intersection of said northwesterly right of way line, and the
aforesaid northerly line of Sni-A-Bar Cutoff; thence South 87E03'00" West, along last said
northerly right of way line, a distance of 70.35 feet to the point of
beginning. Except that part thereof in Byrams Ford Road.
TRACT 2: All that part of Lot 2, William Lane
Estate, a subdivision in Kansas City, Missouri; beginning at a point 221.29 feet
north of a point on the west line of Lot 4, Sni-A-Bar Cutoff, thence North 0E East, 20 feet; thence North 90E East, 75 feet; thence South 82E15'00" East, 148.52 feet; thence
North 90E West, 222.17 feet to
the point of beginning. Except that part thereof in Byrams Ford Road.
is
hereby rezoned from District C-2 (Local Retail Business) to District PD/C-2
(Planned Districts/Local Retail Business), all as shown outlined on a map
marked Section 80-11A0448, which
is attached hereto and made a
part hereof, and which is hereby adopted as a part of an amendment to the
zoning maps constituting a part of said chapter and as an amendment to Section
80-11 thereof.
Section B. That
a development plan for the area legally described above is hereby approved,
subject to the following conditions:
1. That the developer cause the
area to be platted and processed in accordance with Chapter 66, Code of
Ordinances of the City of Kansas City, Missouri, as amended, commonly known as
the Subdivision Regulations, or receive a lot split prior to the approval of a
final plan.
2. That the developer enter into
an agreement for the dedication of additional right of way for Blue Ridge
Cutoff as required by the Department of Public Works so as to provide 50 feet
of right of way as measured from the centerline of Blue Ridge Cutoff at the
time of any City project for the improvement of Blue Ridge Cutoff.
3. That the developer enter into
an agreement for the dedication of additional right of way for Sni-A-Bar Road
as required by the Department of Public Works so as to provide 50 feet of right
of way as measured from the centerline of Sni-A-Bar Road at the time of any
City project for the improvement of Sni-A-Bar Road.
4. That the developer construct
sidewalks and reconstruct driveways along the west side of Blue Ridge Cutoff
as required by the Department of Public Works prior to the approval of the
final plan.
5. That the developer improve the
east half of Byrams Ford Road to residential street standards as required by
the Department of Public Works, including construction of curb, gutter and
sidewalks and installation of streetlights.
6. That the developer submit a
final plan to the City Plan Commission for approval, including detailed
information on landscaping, required screening, signage (including elevations),
lighting (including a photometric study) and building elevations.
A copy of said development
plan is on file in the office of the City Clerk under Document No. 021321,
which is attached hereto and made a part hereof.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
