SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE 001713, AS AMENDED

 

Amending Section 40-369, Code of Ordinances - Reduction in emergency license tax rates, to eliminate the emergency license tax rate on residential gas sales gross receipts now, rather than in three stages, and declaring an emergency.

 

WHEREAS, wholesale natural gas prices have soared to prices many times that incurred in prior years; and

 

WHEREAS, industry analysts predict continued price escalation; and

 

WHEREAS, the average household is expected to use approximately 90,000 cubic feet of gas this winter; and

 

WHEREAS, the dramatically higher additional cost of natural gas this winter will impose severe economic hardship on many of the Citys citizens for which they need immediate economic relief which in part can be provided by an escalation of the elimination of the emergency license tax on residential use of natural gas; and

 

WHEREAS, the Council took steps to remove the emergency tax over time by the passage of Ordinance 001247, but to address the immediate need for relief against escalating natural gas prices the natural gas emergency tax should be eliminated now; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Section 40-369, Code of Ordinances - Reduction in emergency license tax rates, is amended to eliminate the emergency license tax rate on residential gas sales gross receipts now, rather than in three stages, to read as follows:

 

Sec. 40-369. Reduction in emergency license tax rates.

 

(a) The emergency license tax percentage rates imposed on residential sales gross receipts contained in sections 40-345 and 40-361, shall be reduced by one percent on each of the following dates: November 1, 2000, May 1, 2002 and May 1, 2003.

 

(b) Effective January 5, 2001, the emergency license tax imposed on residential gas sales gross receipts contained in section 40-347 shall be eliminated.

 

Section 2. That this ordinance is declared to be an emergency measure within the provisions of Section 15, Article II of the Charter of Kansas City for the immediate protection or the public health and safety and shall take effect in accordance with the provisions of Charter Section 15.
