COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970330

 

Approving the preliminary plat of Country Valley on a 34.2 acre tract of land generally located south of Highway 40 on the east side of Logan Road. (SD 0410E)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Country Valley on a 34.2 acre tract of land generally located south of Highway 40 on the east side of Logan Road, and more specifically described as follows:

 

All that part of the West One-Half of the Southwest Quarter of Section 25, Township 49, Range 32 in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at a point on the east line of the West One-Half of the Southwest Quarter of Section 25, Township 49, Range 32, said point lying 663.40 feet at a bearing of North 02 05'19" East of the southwest corner of said West One-Half; thence North 87 00'58" West a distance of 318.26 feet; thence North 48 02'44" West a distance of 97.12 feet; thence North 50 03'19" West, a distance of 89.77 feet; thence North 35 43"52" West a distance of 86.44 feet; thence North 16 21'01" West a distance of 120.00 feet; thence North 73 38'59" East a distance of 26.75 feet; thence North 16 21'00" West a distance of 285.00 feet; thence North 73 39'00" East a distance of 150.00 feet; thence North 16 21'00" 74.85; thence South 87 19'08" East a distance of 655.41 feet to a point on the east line of said Southwest Quarter Section; thence along said east line South 02 05'19" West a distance of 1437.72 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a permit from the Missouri Highway and Transportation Department prior to working in any State right of way.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

8. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the final plat.

 

9. That the developer submit a street tree planing plan with the final plat and secure the approval of the City Forester.

 

10. That the developer extend sanitary sewers as required by the City Engineer's Office.

 

11. That the developer pay money in lieu of parkland dedication in the amount of $11,719.60 for 124 single family units (63 new single family units) in satisfaction of

Section 66-128 of the Subdivision Regulations.

 

12. That the developer extend the covenants and restrictions as required.

 

13. That the developer submit a traffic study as required by the Missouri Highway and Transportation Department.

 

14. That the developer enter into a Cooperative Agreement with the City whereby the developer contributes $70,000.00 which funds may be utilized for relocated Phelps

Road, south of Highway 40.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 970330, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had. _____________________________________________

 

I hereby certify that as required by Chapter 66, Code of Ordinances, the foregoing ordinance was duly advertised and public hearings were held.
