COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090865, AS AMENDED

 

Rezoning an area of about 21.6 acres located at the northwest corner of Raytown Road and Interstate 470, from District CP-3 to District MP, and approving a development plan. (8589-MP-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0853, rezoning an area of approximately 21.6 acres generally located at the northwest corner of Raytown Road and Interstate 470 from District CP-3 (Regional Planned Business Center) to District MP (Planned Industrial District), said section to read as follows:

 

Section 80-11A0853. That an area legally described as:

 

A tract of land in the Northeast Quarter of Section 32, Township 48N, Range 32W, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the northeast corner of said Section 32, thence North 88 degrees 45 minutes 26 seconds West along the north line of the said Northeast Quarter of said Section 32, 61.09 feet to a point on the westerly right-of-way line of the relocated Raytown Road, as established by Commissioners Report recorded in the Office of the Recorder of Deeds for Jackson County, Missouri as Document No. I-40407 in Book I-117, page 762, said point also being the true point of beginning; thence leaving said north section line along said westerly right-of-way line the following courses and distances: South 0 degrees 00 minutes 41 seconds West, 20.41 feet; thence along a curve to the right having a radius of 1085.92 feet an arc length of 291.89 feet and a chord bearing of South 07 degrees 42 minutes 42 seconds West; thence South 29 degrees 55 minutes 47 seconds West, 95.96 feet; thence along a curve to the right having a radius of 1065.92 feet, an arc length of 714.84 feet and a chord bearing of South 39 degrees 37 minutes 28 seconds West; thence South 58 degrees 50 minutes 12 seconds West, 205.87 feet; thence along a curve to the left having a radius of 1225.92 feet, an arc length of 163.06 feet and a chord bearing of South 55 degrees 01 minutes 34 seconds West; thence leaving said westerly right-of-way line North 34 degrees 53 minutes 30 seconds West, 319.71 feet; thence along a curve to the right having a radius of 539.50 feet, an arc length of 328.69 feet and a chord bearing of North 17 degrees 26 minutes 23 seconds West; thence North 00 degrees 03 minutes 07 seconds East, 585.60 feet to a point on the north line of the Northeast Quarter of said Section 32; thence along said north line, South 88 degrees 45 minutes 26 seconds East, 1123.61 feet to the true point of beginning, containing 21.56 acres more or less (938,936.52 SQFT±) and being subject to all public roads, easements, reservations, restrictions, covenants, and conditions, if any, now of record.

 

is hereby rezoned from District CP-3 (Regional Planned Business Center) to District MP (Planned Industrial District), all as shown outlined on a map marked Section 80-11A0544, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer provide adequate intersection sight distance for both driveway intersections as required by Development Services.

 

2.                  That the developer construct all turning lanes and roadway improvements as shown on the development plan with Phase I.

 

3.                  That the developer dedicate 60 feet of right of way for a collector street for future 99th Street as required by Development Services as measured from the centerline of Old Raytown Road and tapering to provide the southerly half of 30 feet at the westerly property line.

 

4.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

5.                  That the developer submit a macro/micro storm drainage study to Development Services for review and acceptance for the entire development when the first plat is submitted, and that the developer construct any improvements as required by Development Services.

 

6.                  That the developer enter into an unsecured deferral agreement, prior to recording the final plat, for the improvement of the southern one-half of 99th Street to collector street standards, as required by Development Services, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities, at such time that any adjacent north one-half of 99th Street is constructed.

 

7.                  That the developer pay impact fees as required by Chapter 39 of the Kansas City, Missouri Code of Ordinances.

 

8.                  That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

9.                  That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer be responsible for all costs associated with subordination activities now and in the future.

 

10.              That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities.

 

11.              That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

12.              That the public sanitary sewer system be extended to serve the proposed buildings.

 

13.              That the developer grant a BMP Easement to the City as required by Development Services prior to recording the final plat.

 

14.              That the developer submit a final plan to the City Plan Commission for approval that includes, plans for grading, building elevations, landscaping, screening (including wall), signage, lighting and photometric study showing zero footcandles at the lot lines. This shall include the landscape buffer along northerly property line.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
