COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 140860

 

Recognizing a new blight study and reaffirming the finding of blight made in Committee Substitute for Ordinance No. 140223 regarding property located at the southeast corner of 20th Street and Main Street.

 

WHEREAS, the City Council enacted Committee Substitute for Ordinance No. 140223 on April 24, 2014, finding property located at 20th and Main to be blighted, substandard and insanitary and authorizing condemnation of a billboard and ancillary rights on the site; and

 

WHEREAS, said ordinance and its blight finding has been challenged in court; and

 

WHEREAS, a new blight study has been performed on the same property by Belke Appraisal and Consulting Services, Inc. in connection with a Tax Increment Financing Plan application; and

 

WHEREAS, the new blight study confirms that the property located at the southeast corner of 20th Street and Main Street is blighted and supports the Council's previously made blight finding; and

 

WHEREAS, the new study finds that the property suffers from severe economic underutilization and an inability to pay reasonable taxes, as well as social liability; and  

 

WHEREAS, the new study cites the permanent easements for the billboard located on the property (granted in Instrument Number 2007E0113421, Jackson County Missouri) as a hindrance to the full development of the site, and states that the easement rights significantly limit any effective use of the site; and

 

WHEREAS, the new study cites the City’s area plan as discouraging surface parking lots in the Crossroads area, and designates the south end of the site as a “secondary gateway,” and finds that the presence of the looming billboard distracts from that gateway status; and

 

WHEREAS, the new study finds that the “billboard easement inhibits the important Main Street view corridor to Crown Center, Union Station, and Liberty Memorial, as well as inhibiting redevelopment of the property to its highest and best use (due to view obstructions)”; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Mayor and Council hereby recognize the new, additional blight study for this property, a copy of which is attached to this resolution, which study further supports the Council’s blight finding made in Committee Substitute for Ordinance No. 140223.

 

Section 2. That the Mayor and Council find that the new study provides additional evidence and further confirms that the property located at the southeast corner of 20th Street and Main Street is blighted, substandard and insanitary, and that the billboard and its permanent easements granted in Instrument Number 2007E0113421 hinder the opportunity for redevelopment of this blighted property, and that an eminent domain action which condemns and takes interests in said property for the public use of the removal of blight is proper and necessary.
