ORDINANCE NO. 070392

 

Approving an amendment to a previously approved development plan in District URD on a 4.87 acre tract of land generally located at the southeast corner of 45th Street and Main Street. (11744-URD-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on a 4.87 acre tract of land generally located at the southeast corner of 45th Street and Main Street, and more specifically described as follows:

 

Tracts 1 and 2, Plaza Inn, a subdivision lying in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

2. That the developer secure permits to repair or reconstruct existing sidewalks, curbs, gutters, storm sewers, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curbs, and gutters are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to issuance of a certificate of occupancy.

 

3. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

5. That the developer submit a streetscape plan for approval and permitting by Development Services prior to beginning work in the public right of way.

 

6. That the developer re-stripe 45th Street at Main Street creating one eastbound 14 foot wide lane and a dual 10 foot wide westbound left turn lane and a 10 foot wide shared westbound through/right turn lane as required by the Public Works Department.

 

7. That the developer modify the traffic signal at the intersection of 45th Street and Main Street as required by the Public Works Department.

 

8. That the developer install video detection equipment at the intersection of 47th Street and Main Street as required by the Public Works Department.

 

9. That the developer dedicate additional right of way upon replatting or by general warranty deed for a primary arterial street as required by Development Services so as to provide a total of 50 feet of right of way as measured from the centerline of Main Street prior to the issuance of a building permit.

 

10. That the developer dedicate additional right of way upon replatting or by general warranty deed (separate document) for a collector street as required by Development Services so as to provide a total of 30 feet of right of way as measured from the centerline of 45th Street prior to the issuance of a building permit.

 

11. That the developer dedicate additional right of way upon replatting or by general warranty deed for a collector street as required by Development Services so as to provide a total of 30 feet of right of way as measured from the centerline of Walnut Street prior to the issuance of a building permit.

 

12. That the developer provide for fire protection as required by the Fire Department.

 

13. That the developer obtain permission for an encroachment ordinance of the office/commercial building within the Main Street right of way as required by Development Services, prior to the issuance of a building permit.

 

14. That the developer remove Phase One from the Bedrock 353 Development plan prior to the issuance of a demolition permit.

 

15. That the developer submit a site plan to the Director of the Department of City Development for approval prior to the issuance of a building permit. The site plan shall include information regarding: property uses, setback distances, lighting, landscaping and architectural characteristics, berms, trees and plantings around and within the parking lots; show proposed pedestrian circulation; and include elevation drawings of buildings and signage along with a photometric study showing zero footcandles at the property line.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
