COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 011700

 

Approving an amendment to a previously approved development plan in District GP-3/4 (Regional Business, High Density Residential Uses) on approximately a 34.7 acre tract of land generally located at the northwest corner of N.W. Barry Road and Interstate 29, for the purpose of deleting an approximately 33.8 acre tract of land from said development plan. (12646-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-3/4 (Regional Business High Density Residential Uses) on approximately a 34.7 acre tract of land generally located at the northwest corner of N.W. Barry Road and Interstate 29, and more specifically described as follows:

 

Containing 1,193,518 square feet or 27.3994 acres.

 

A tract of land situated in the NE 1/4 of Section 12, Township 51, Range 34, Kansas City, Platte County, Missouri, described as follows: Commencing at the southwest corner of said NE 1/4; thence South 8949'30" East, along the south line of said NE 1/4, 1402.40 feet (deed = 1402.94 feet); thence North 0010'30" East, 65.00 feet to a point on the east right of way line of Winter Avenue as dedicated by Prairie Point Manor, a subdivision in said Kansas City. Said point being the point of beginning of the tract to be described herein. Thence North 0010'30" East, along the east right of way line of said Winter Avenue, 184.23 feet (plat = 183.66 feet), thence northeasterly, continuing along said line, and along the south line of Thistle Hill, a subdivision in said Kansas City, Missouri, on a curve to the right, having a radius of 125.00 feet and tangent to the last described course, an arc distance of 196.35 feet; thence South 8949'30" East, continuing along the south line of said Thistle Hill, 213.92 feet (plat = 214.22 feet) to a line that is 1741.36 feet (deed = 1741.64 feet) east of the west line of said NE 1/4; thence North 0010'06" East, along said line, and along the east line of said Thistle Hill, 1712.49 feet to the west right of way line of Interstate Route I-29 as recorded in Book 517 at page 294; thence South 4437'49" East, along said line, 80.26 feet to a point 1020.00 feet from and opposite centerline Station 659+60; thence South 8937'49" East, along the westerly right of way line of said I-29, as recorded in Book 749 at page 396, 185.00 feet to a point 835.00 feet from and opposite said centerline Station 659+60; thence South 3041'22" East, continuing along said line, 513.64 feet to a point 570.00 feet from and opposite centerline Station 664+00; thence South 2742'10" East, continuing along said line, 340.00 feet to a point 410.00 feet from and opposite centerline Station 667+00; thence South 0725'40" West, continuing along said line, 529.01 feet to a point 475.00 feet from and opposite centerline Station 672+25; thence South 1238'01" East, continuing along said line, 384.87 feet to a point 388.40 feet from and opposite centerline Station 676+00; thence North 8937'49" West, continuing along said line, 89.60 feet to a point 478.00 feet from and opposite said centerline Station 676+00, said point being on the westerly right of way line as described in said Book 517 at page 294; thence South 1555'37" West, along said line, 200.45 feet to the southeast


corner of Lot 1, Barry Park, a subdivision in said Kansas City; thence North 8949'30" West, along the south line of said Lot 1, 122.96 feet to the southwest corner of Lot 1; thence South 0010'06" West, along the west line of Lot 2, said Barry Park, 135.01 feet to the north right of way line of Barry Road (Route T); thence North 8949'30" West, along said line, parallel with and 60.00 feet north of the south line of said NE 1/4, 50.00 feet; thence South 0010'06" West, continuing along said line, 10.00 feet; thence North 8949'30" West, continuing along said line, parallel with and 50.00 feet north of the south line of said NE 1/4, 150.00 feet; thence South 0010'06" West, continuing along said line, 10.00 feet; thence North 8949'30" West, continuing along said line, 40.00 feet north of and parallel with the south line of said NE 1/4, 529.36 feet; thence northwesterly, continuing along said line, on a curve to the right, having a radius of 25.00 feet, and tangent to the last described course, an arc distance of 39.27 feet to the point of beginning.

 

NOTE: The above description is the same tract as described in a Beneficiary Deed recorded in Book 764 at page 112 at the Recorders Office in Platte County, Missouri, and three title reports by Thompson Title Corporation, File Nos. L11269-Lb, P-1672-a and P-1729-a; and

 

An additional tract of approximately 6.99 acres is included in this development which generally lies between the existing property and the existing Interstate 29 southbound off ramp to Barry Road. This additional tract is bounded on the west by the above described property and the eastern side of Lot 2, Barry Park; on the south by a line parallel to and 70.00 feet from the centerline of Barry Road right of way; on the east by a curved line parallel to and 50.00 feet from the Interstate 29 off ramp; on the north by an extension of the existing property line at the northernmost corner of the existing property. This additional tract excludes Lot 2, Barry Park.

Beginning at the southeast corner of said Lot 1, said point also being on the north right-of-way line of N.W. Barry Road; thence South 86E25'04" West on the south line of said Lot 1, a distance of 121.61 feet; thence North 89E49'21" West continuing on said south line a distance of 21.43 feet; thence North 00E10'15" East on the west line of said Lot 1, a distance of 274.23 feet; thence South 89E49'21" East on the north line of said Lot 1, a distance of 146.73 feet to a point on the east line of said Lot 1; thence South 00E10'15" West on said east line a distance of 75.36 feet; thence South 01E21'18" West continuing on said east line a distance of 190.93 feet to the point of beginning. Contains 39,344 square feet or 0.903 acres more or less.

is hereby approved, subject to the following condition:

 

1. That the developer submit a final plan for any change to the existing development to the City Plan Commission for approval, including detailed information on landscaping, grading, signage (including elevations), building elevations and lighting, including a photometric study.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 011700, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
