COMMITTEE SUBSTITUTE FOR
ORDINANCE NO. 020808
Approving
the First Amendment to the Development Plan submitted by the Bishop Spencer Place
Redevelopment Corporation on a tract of land of approximately 7 acres generally
located south of 43rd Street, north of W. 44th Street, east of Madison Avenue
and west of Jefferson Street; declaring additional land as a blighted area and
its redevelopment necessary for the preservation of the public peace,
prosperity, health, safety, morals and welfare.
WHEREAS,
Bishop Spencer Place Redevelopment Corporation, an urban redevelopment
corporation organized under and pursuant to the Urban Redevelopment
Corporations Law and amendments thereto, filed with the City Clerk an
application for approval of a Development Plan on September 24, 1993, which was
approved by the City Council by Committee Substitute for Ordinance No. 931406;
passed December 20, 1993; and
WHEREAS,
Bishop Spencer Place Redevelopment Corporation filed with the City Clerk an
application for a First Amendment to the Development Plan on January 18, 2002
and revised on February 4, 2002, March 22, 2002 and May 22, 2002, ; and
WHEREAS,
the City Plan Commission caused to be published in The Pulse, a newspaper doing
the City's printing, on April 22, 2002, that date being not less than ten days
prior to the date set for the hearing, notice of the public hearing on the
First Amendment to the Development Plan; and
WHEREAS,
said City Plan Commission held a public hearing on the First Amendment to the
Development Plan on May 7, 2002; and
WHEREAS,
at the public hearing conducted by the City Plan Commission, all interested
parties were given an opportunity to be heard; and
WHEREAS,
the City Plan Commission has made a study and investigation of the proposed
First Amendment to the Development Plan and on May 7, 2002, recommended
approval of the First Amendment to the Development Plan and submitted a report
of the same, a copy of which is attached hereto and incorporated herein by
reference as Exhibit "A"; NOW, THEREFORE,
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. That the application of the Bishop Spencer Place Redevelopment Corporation
for approval of a First Amendment to the Development Plan, including all
exhibits incorporated therein, is hereby incorporated by reference and approved
as a First Amendment to the Development Plan as originally approved by
Committee Substitute for Ordinance No. 931406, passed December 20, 1993. A
copy of the application and exhibits are on file in the office of the City
Clerk under Document No. 020808, which is attached hereto and incorporated
herein by reference.
Section
2. That the Council hereby finds and declares that good cause has been shown
for the approval of the First Amendment to the Development Plan of the Bishop
Spencer Place Redevelopment Corporation and that the findings and declarations
made by the Council in Section 2 and 4 of Committee Substitute for Ordinance
No. 931405 with respect to the Development Plan have not been affected by the
amendments thereto and equally apply to said Development Plan, as amended.
Section
3. That the Council finds and declares that the area being described in the
amendment to the development plan submitted by Bishop Spencer Place
Redevelopment Corporation is a blighted area as defined by Section 353.020(2),
Revised Statutes of Missouri, and Chapter 74 of Code of General Ordinances of
Kansas City, Missouri, and the redevelopment thereof is necessary for the
public convenience and necessity; and that approval of such amendment and the
construction of the project are necessary for the preservation of the public
peace, prosperity, health, safety, morals and welfare.
Section
4. That the Council hereby finds and determines that the public convenience
and necessity will be served by the Development Plan, as amended.

hereby certify that all public notices have been given and hearings have been
held as required by Chapter 74, Code of Ordinances of the City of Kansas City,
Missouri.
