COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 960769
Amending Chapter 65, Revised Ordinances of Kansas City,
Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section
to be known as Section 65.010A2663, rezoning an area of approximately 320 acres
generally located at the northeast corner of N.W. 112th Street and N. Congress
Avenue from District GP-7 (Agricultural and Low Density Residential Uses) to
District GP-1 (General Industry), and approving a development plan for the
same. (11799-GP)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 65, Revised Ordinances of
Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby
amended by enacting a new section to be known as Section 65.010A2663, rezoning
an area of approximately 320 acres generally located at the northeast corner of
N.W. 112th Street and N. Congress Avenue from District GP-7 (Agricultural and
Low Density Residential Uses) to District GP-1 (General Industry), said section
to read as follows:
Section 65.010A2663. That an area legally described
as:
TRACT 1: The North One-Half of the Northwest Quarter
of the Southeast Quarter, Section 24, Township 52, Range 34 West, Kansas
City, Platte County, Missouri.
In the East One-Half of the Southeast Quarter
Section 24, Township 52, Range 34 West, Kansas City, Platte County,
Missouri.
The Southwest Quarter of Section 19, Township 52,
Range 33 West, Kansas City, Platte County, Missouri, except that part
deeded to the State of Missouri in Book 136, page 537.
TRACT 2: The Southwest Quarter of the Southeast
Quarter of Section 24, Township 52, Range 34 West, Kansas City, Platte
County, Missouri.
The South One-Half of the Northwest Quarter of the
Southeast Quarter of Section 24, Township 52, Range 34 West, Kansas City,
Platte County, Missouri.
is hereby rezoned from District GP-7 (Agricultural and
Low Density Residential Uses) to District GP-1 (General Industry), all as shown
outlined on a map marked Section 65.010A2663, which is attached hereto and made
a part hereof, and which is hereby adopted as a part of an amendment to the
zoning maps constituting a part of said chapter and as an amendment to Section
65.010 thereof.
Section B. That a development plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for the entire development when
the first plat is submitted for approval and that the
developer make any improvements as required by
the City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to the commencement of any construction
activities.
4. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
5. That the developer provide for fire protection
as required by the Fire Department.
6. That the developer grant a Noise and Aviation
Easement to the City.
7. That the developer construct and maintain all
structures in compliance with the KCI Airport Height Zoning maps on
file with the City Clerk.
8. That the developer dedicate additional right of
way for N.W. 112th Street as required by the Department of Public
Works so as to provide 50 feet of right of way as
measured from the centerline of N.W. 112th
Street.
9. That the developer enter into a deferral
agreement for the improvement of the north half of N.W. 112th Street
to primary arterial street standards as required by the
Department of Public Works at such time that
the land to the south of the property
is developed or a permanent access drive is
constructed on the south side of the
property which accesses N.W. 112th Street,
whichever first occurs.
10. That the developer dedicate additional right of
way for N. Skyview Avenue in phases at the time of platting as
required by the Department of Public Works so as to provide
50 feet of right of way as measured from the
centerline of N. Skyview Avenue.
11. That the developer improve one-half of N.
Skyview Avenue to primary arterial street standards in phases at the
time of platting as required by the Department of Public
Works.
A copy of said development plan is on file in the office
of the City Clerk under Document No. 960769, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
