ORDINANCE NO. 020286

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0414, rezoning an area of approximately 11.25 acres generally located at the northwest corner of N.E. 48th Street and N.E. Randolph Road from District C-2 (Local Retail Business) to District R-4 (Low Apartments). (11796-P-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0414, rezoning an area of approximately 11.25 acres generally at the northwest corner of N.E. 48th Street and N.E. Randolph Road from District C-2 (Local Retail Business) to District R-4 (Low Apartments), said section to read as follows:

 

Section 80-11A0414. That an area legally described as:

 

A tract of land located in the Southeast Quarter of Section 33, Township 51 North, Range 32 West of the Fifth Principle Meridian, Kansas City, Clay County, Missouri, being more particularly described as follows: Commencing at the northwest corner of the South One-Half of the Southeast Quarter of said Southeast Quarter; thence South 89E26'52" East along the north line of the South One-Half of the Southeast Quarter of said Southeast Quarter, a distance of 154.21 feet to the point of beginning of the tract of land to be described; thence continuing South 89E26'52" East along the north line of the South One-Half of the Southeast Quarter of said Southeast Quarter, a distance of 969.43 feet to the west right-of-way line of I-435; thence South 34E48'11" West along said west right-of-way line, a distance of 207.55 feet; thence South 17E26'34" West continuing along said west right-of-way line, a distance of 434.57 feet; thence South 00E43'33" West continuing along said west right-of-way line, a distance of 6.05 feet; thence North 89E24'02" West continuing along said west right-of-way line, a distance of 225.08 feet; thence South 00E35'58" West continuing along said west right-of-way line, a distance of 12.82 feet to a point on the north right-of-way line of N.E. 48th Street; thence along said north right-of-way line, on a curve to the right, having a radius of 3,779.72 feet, an initial tangent bearing of North 85E24'27" West and an arc length of 57.74 feet; thence continuing along said north right-of-way line on a curve to the left, tangent to the last described course, having a radius of 2,904.79 feet and an arc distance of 446.40 feet; thence North 00E51'11" East, a distance of 429.85 feet; thence North 00E3308 East, a distance of 167.72 feet to the point of beginning. Contains 490,215 square feet or 11.25 acres, more or less.

 

is hereby rezoned from District C-2 (Local Retail Business) to District R-4 (Low Apartments), all as shown outlined on a map marked Section 80-11A0414, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
