ORDINANCE NO. 080280

Repealing Sections 1 and 2 of Committee Substitute for Ordinance Number 080071 which authorized execution of an Easement Exchange Agreement and a permanent road easement with Briarcliff Development Company; authorizing the Director of Water Services to execute an Easement Exchange Agreement with Briarcliff Development Company and Briarcliff Parkway and Highway 9 Transportation Development District; authorizing the Director of Water Services to execute a permanent road easement with Briarcliff Parkway and Highway 9 Transportation Development District; and directing the City Clerk to record these documents and this ordinance with the Office of the Recorder of Deeds for Platte County, Missouri.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Section 1 of Committee Substitute for Ordinance Number 080071, which authorized execution of an Easement Exchange Agreement with Briarcliff Development Company, is hereby repealed.

Section 2. That the Director of the Water Services Department is hereby authorized to execute a three-party Easement Exchange Agreement with Briarcliff Development Company and Briarcliff Parkway and Highway 9 Transportation Development District wherein the City grants a permanent roadway easement to Briarcliff Parkway and Highway 9 Transportation Development District and Briarcliff Development Company grants the City a permanent water/sewer/trails easement at a later date. This agreement, in substantial form, is on file in the office of the Director of Water Services.

Section 3. That Section 2 of Committee Substitute for Ordinance Number 080071, which authorized a permanent road easement for Briarcliff Development Company, is hereby repealed.

Section 4. That the Director of the Water Services Department is hereby authorized to execute a permanent roadway easement with Briarcliff Parkway and Highway 9 Transportation Development District. This easement, in substantial form, is on file in the office of the Director of Water Services.

Section 5. That upon the effective date of this Ordinance and execution of the Easement Exchange Agreement and the Roadway Easement, the City Clerk is hereby directed to cause this ordinance and these documents to be recorded in the Office of the Recorder of Deeds for Platte County, Missouri.
