ORDINANCE NO. 940616

 

Approving an amendment to a previously approved preliminary plan in District C-1-p (Neighborhood Retail Business - Limited District) on a 0.9 acre tract of land generally located 100 feet east of N. Cypress on the north side of N.E. Vivion Road. (7082-P-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-1-p (Neighborhood Retail Business - Limited District) on a 0.9 acre tract of land generally located 100 feet east of N. Cypress on the north side of N.E. Vivion Road, and more specifically described as follows:

 

Lot 14, Block 14, Foxwoods Subdivision, Kansas City, Clay County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for

approval at the time the first final plat is submitted

and that the developer make any improvements as required

by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for

approval prior to beginning any construction activities.

 

4. That the developer install hard surface roads and provide for fire protection prior to construction beyond

foundations.

 

5. That the developer extend water mains as required by the Water Department.

 

6. That the developer dedicate additional right of way for N.E. Vivion Road for a total of 50 feet of right of way

from centerline of N.E. Vivion Road.

 

7. That the developer improve N.E. Vivion Road to arterial street standards or as required by the City and the

Missouri Highway and Transportation Department.

 

8. That the developer obtain a permit from the Missouri Highway and Transportation Department prior to any work

within State highway right of way.

 

9. That the developer submit final plans for each stage of development to the City Plan Commission for approval.

The final plans shall include: site plan, to include the

location and direction of any outdoor lighting; dimension

plan; grading plan; landscaping planting plan; and

location and detailed plans for signage.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 940616, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
