ORDINANCE NO. 170743

Authorizing an amendment to the agreement with the Negro Leagues Baseball Museum, Inc. in the amount of $10,676.00 for the John “Buck” O’Neil Education and Research Center project, 1824 Paseo Boulevard, Kansas City, Missouri; waiving the local match requirement; and designating replacement local match funds.

WHEREAS, on October 6, 2016, Council authorized a Kansas City Brownfields Revolving Loan Fund subgrant agreement in the amount of $115,200.00 with Negro Leagues Baseball Museum, Inc. (NLBM) to hire a contractor and pay other costs necessary for abatement activities at the John “Buck” O’Neil Education and Research Center, 1824 Paseo Boulevard, Kansas City, Missouri (“Project”); and

WHEREAS, the sole responsive bid for the abatement work exceeded the estimate by $24,876.00 for the Project; and

WHEREAS, an amendment is now needed to enable NLBM to compensate its contractor for the Project; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1.  That the Director of City Planning and Development is authorized to execute Amendment No. 1 in the amount of $10,676.00 as additional funding of the Kansas City Brownfields Revolving Loan Fund subgrant agreement with the Negro Leagues Baseball Museum, Inc., for abatement activities at the John “Buck” O’Neil Education and Research Center, 1824 Paseo Boulevard, Kansas City, Missouri, bringing the total agreement amount to $125,876.00. A copy of the amendment is on file in the City Planning and Development Department.

Section 2.  That the Director of City Planning and Development is hereby authorized to expend the sum of $8,897.00 from funds previously appropriated to Account No. 18-2550-645020-B-G64BRLF.

Section 3. That funds in the following appropriation in the Series 2017A Bond Fund be reduced in the following amount:

AL-3436-648043-B-64017101 18th & Vine Phase 1-3 $1,779.00

Section 4. That the requirement that NLBM provide local matching funds of twenty percent (20%) is hereby waived and in its place, matching funds not to exceed $1,779.00 are added to the NLBM subgrant from the Unappropriated Fund Balance to the following account:

AL-3436-645020-B-G64BRLF EPA Brownfields Revolving Loan $1,779.00

Section 5.  That the Director of City Planning and Development is hereby authorized to expend the sum of $1,779.00 from Account No. AL-3436-645020-B-G64BRLF.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
