ORDINANCE NO. 010131

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0343, rezoning an area of approximately 10.48 acres generally located on the east side of Campbell Street between 22nd Street and 24th Street from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section, rezoning an area of approximately 10.48 acres generally located on the east side of Campbell Street between 22nd Street and 24th Street from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments), to read as follows:

 

Section 80-11A0343. That an area legally described as:

 

A tract of land in the Southeast Quarter and the Northeast Quarter of Section 8, Township 49 South, Range 33 West of the Fifth Principal Meridian in the City of Kansas City, Jackson County, Kansas, said tract being more particularly described as follows: Commencing at the southeast corner of the Southeast Quarter of the Northeast Quarter of said Section 8; thence North 87E15'27" West, 52.54 feet, along the south line of the Southeast Quarter of said Section 8, to the true point of beginning; thence North 87E15'27" West, 131.71 feet along said south line; thence South 02E23'45" West, 230.12 feet to a point on the south line of Lot 2, Beacon Hill, a subdivision of land in the City of Kansas City, Jackson County, Missouri; thence North 87E14'32" West, 30.75 feet along said south line; thence South 02E23'44" West, 210.13 feet to a point on the north right of way line of 24th Street, as now established; thence North 87E13'27" West, 491.92 feet, along said north right of way line, to the beginning of a curve concave to the northeast having a radius of 15.00 feet; thence northwesterly 23.72 feet, along said curve to the right having a chord bearing North 42E31'39" West, 21.33 feet, to a point on the east right of way line of Campbell Street, as now established; thence North 02E10'10" East, 425.06 feet, along said east right of way line, to a point on the north line of the Northeast Quarter of the Southeast Quarter of said Section 8; thence North 02E15'10" East, 394.70 feet, along said east right of way line, to the beginning of a curve concave to the southeast having a radius of 15.00 feet; thence northeasterly 23.43 feet, along said curve to the right having a chord bearing North 47E30'00" East, 21.12 feet, to a point on the south right of way line of 22nd Street, as now established; thence South 87E15'56" East, 380.04 feet, along said south right of way line, to a point on the east right of way line of Harrison Street, as now established; thence South 02E14'15" West, 35.00 feet along said east right of way line; thence South 87E17'09" East, 110.00 feet to a point on the westerly right of way line of Bruce R. Watkins Trafficway, as now established; thence South 02E14'15" West, 165.00 feet along said


westerly right of way line; thence South 87E17'09" East, 48.00 feet, along said westerly right of way line, to a point on the west line of Lot 12, Block 9, John C. Merines Subdivision, a subdivision of land in the City of Kansas City, Jackson County, Missouri; thence South 28E01'01" East, 209.38 feet, along said westerly right of way line, to a point on the north right of way line of 23rd Street, as now established; thence South 20E14'23" East, 32.59 feet to the true point of beginning of the tract herein described. Containing 456,519 square feet or 10.4802 acres, more or less. Subject to all easements and restrictions of record.

 

is hereby rezoned from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments), all as shown outlined on a map marked Section 80-11A0343, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer install and/or upgrade streetlights on Troost Avenue, Campbell Street and 24th Street as required by the Department of Public Works.

 

6. That the developer extend sanitary sewers as required by the Department of Public Works.

 

7. That the developer secure a permit form the Missouri Department of Transportation prior to working within any State right of way.

 

8. That the developer receive the approval of the Board of Zoning Adjustment for any subdivision identification signs.

 

9. That the developer receive any necessary variances from the Board of Zoning Adjustment.

 

10. That the developer submit a final plan to the City Plan Commission for approval.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 010131, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been held as required by the Zoning Ordinance.
