RESOLUTION NO. 100657

Stating City Council support for a break in access along Route 45 between North Chatham Drive and North Cosby Avenue; and directing the City Clerk to transmit this Resolution to certain individuals.

WHEREAS, the City of Kansas City, with the passage of Ordinance No. 080150 on March 6, 2008, modified the City’s Major Street Plan in the vicinity of Interstate 29 and Route 45; and

WHEREAS, private property owners, in conjunction with the City, propose to make improvements over a period of time that will increase the capacity of the Interstate 29 and Missouri Route 45 interchange in Platte County, Missouri, including relocating the existing outer road and widening existing State streets; and

WHEREAS, the City of Kansas City, with the passage of Ordinance No. 090632 on July 30, 2009, facilitated completion of the first phase of the implementation of the Major Street Plan as outlined in Ordinance No. 080150; and

WHEREAS, the City of Kansas City, with the passage of Ordinance No. 090632, also committed to maintenance and operation of portions of the State’s interstate outer road system; and

WHEREAS, in order to continue the implementation of the Major Street Plan, the City will be working with the adjacent property owner to submit a formal request for a break in access which will eventually need approval by the Missouri Highways and Transportation Commission; and

WHEREAS, the City has met with the appropriate staff of MoDOT at the district level and will work to prepare plans for the break in access; and

WHEREAS, the City appreciates the help and assistance of MoDOT staff in developing plans for the break in access that meet MoDOT standards and expectations; and

WHEREAS, continued implementation of the City’s Major Street Plan requires the Missouri Highways and Transportation Commission to grant this mutually beneficial break in access to the owner of Tremont Square Shopping Center; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

That the City Council expresses its support for the granting of a break in access along Route 45 between North Chatham Drive and North Cosby Avenue and requests that the Missouri Highways and Transportation Commission approve the break in access request.

BE IT FURTHER RESOLVED that this Resolution be immediately transmitted to the Governor of the State of Missouri, the Kansas City delegation to the Missouri General Assembly, and the Missouri Highways and Transportation Commission.
