ORDINANCE NO. 970866
Amending Chapter 2, Administrative Code, Code of
Ordinances, by repealing Section 2-937, Additional program requirements and
restrictions, and enacting in lieu thereof one new section of like number and
subject matter.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That Chapter 2, Administrative Code,
Code of Ordinances, is hereby amended by repealing Sections 2-937, and enacting
a new section to read as follows:
Sec. 2-937. Additional program requirements and
restrictions.
The following additional requirements for funding
are established:
(1) Every corporation receiving neighborhood
tourist development fund monies must maintain its registered office
within the city limits.
(2) The schedule of ineligible and eligible
expenses found in section 2-939(b) must be followed.
(3) Applications for each proposal are limited to a
total of (a) two districts or (b) one district and the city-wide
account. This limitation does not prohibit other districts
from voluntarily contributing funds on their
own initiative to any project.
(4) All neighborhood tourist development fund
contracts must be executed within 120 days from the effective date
of the ordinance authorizing the contract unless waived
by the City Manager or the City Manager's
designee. Failure of the contractor to
comply with this provision will result in the
reversion of the funds allocated for the
project to the account from which funds
originated.
(5) No neighborhood tourist development fund
contract shall be approved unless such contract is made upon a
consideration wholly to be performed or executed subsequent to the making
of the contract.
(6) After each quarterly recommendation by the NTDF
committee but prior to the expenditure of any funds, the staff will
hold a meeting with all grant recipients to explain the process and
to distribut e disbursement f iles for each project. The staff will assist
organizations receiving NTDF funding in the preparation of required
disbursement documents. Distribution of funds will be contingent upon the
prompt return of the disbursement file to the city and the contractor's
compliance with the requirements of section 2-936.
