ORDINANCE NO. 970657

 

Approving an amendment to a previously approved development plan in District GP-2 (General Transient Retail Business) on approximately a 44 acre tract of land generally located west of Interstate 29, on the north and south sides of Tiffany Springs Parkway. (5985-GP-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-2 (General Transient Retail Business) on approximately a 44 acre tract of land generally located west of Interstate 29, on the north and south sides of Tiffany Springs Parkway, and more specifically described as follows:

 

All that part of the SE 1/4 of Section 35 and all that part of the W 1/2 of Section 36, all in Township 52, Range 34, Kansas City, Platte County, Missouri, more particularly described as follows: Beginning at the southwest corner of the NW 1/4 of said Section 36; thence North 0 31'49" East, along the west line of the NW 1/4 of said Section 36, a distance of 680.14 feet, to the southwest corner of Lot 1, Block 2, Tiffany Springs Industrial Park and Office Center, a subdivision of land in Kansas City, Platte county, Missouri; thence South 72 28'46" East, along the southerly line of said Lot 1, a distance of 230.04 feet; thence North 89 22'42" East, along the southerly line of said Lot 1, a distance of 311.13 feet, to the southeasterly corner thereof; thence North 41 44' East, along the southeasterly line and its extension of said Lot 1, a distance of 220 feet, to a point on the centerline of N.W. 101st Street Terrace, as now established; thence southeasterly and southerly, along the centerline of said N.W. 101st Street Terrace, said line being on a curve to the right, having a radius of 818.51 feet, a central angle of 45 36'32", and whose initial tangent bearing is South 48 16' East, a distance of 651.56 feet, to a point of tangency; thence South 2 39'28" East, a distance of 78.69 feet, to a point of curvature; thence southerly and southwesterly, along a curve to the right, having a radius of 300 feet and a central angle 54 27'41", a distance of 285.16 feet, to a point of tangency; thence South 51 48'13" West, a distance of 44.73 feet, to a point of curvature; thence southwesterly, along a curve to the left, having a radius of 1100 feet and a central angle of 25 , a distance of 479.97 feet, to a point of tangency; thence South 26 48'13" West, a distance of 336.10 feet, to a point of curvature; thence southwesterly and southerly, along a curve to the left, having a radius of 500 feet and a central angle of 27 , a distance of 235.62 feet, to a point of tangency; thence South 0 11'47" East, a distance of 279.96 feet, to a point on the centerline of N. Conant Avenue, said point also being on the south line of the N 1/2 of the SW 1/4 of said Section 36; thence South 89 48'13" West, along the south line of the N 1/2 of the SW 1/4 of said Section 36 and along the north line and its extension of Lot 1, Block 8, Platte Industrial Park, a subdivision of land in Kansas City, Platte County, Missouri, a distance of 279.96 feet, to the southwest corner of the N 1/2 of the SW 1/4 of said Section 36; thence South 0 28'35" West, along the west line of the SW 1/4 of said Section 36 and along the east line of the SE 1/4 of said Section 35, a distance of 200 feet; thence South 89 42'30" West, a distance of 2650.23 feet, to a point on the west line of the SE 1/4 of said Section 35 and 1527.12 feet south of the northwest corner thereof, as measured along said west line; thence North 0 32'24" East, along the west line of the SE 1/4 of said Section 35, a distance of 1527.12 feet, to the northwest corner thereof; thence North 89 42'30" East, along the north line of the SE 1/4 of said Section 35, a distance of 2648.53 feet, to the point of beginning. All of Lot 3, Block 1, Tiffany Springs Industrial and Office Center, Second Plat, a subdivision of land in Kansas City, Platte County, Missouri. The above described tract of land contains 129.468 gross acres, more or less.

 

Also, all of Lot 1, Block 1 and Lot 1, Block 2, Tiffany Springs Industrial and Office Center, a subdivision of land in Kansas City, Platte County, Missouri.

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first final plat is submitted and that the

developer make any improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer dedicate additional right of way for N. Conant Avenue (south of Tiffany Springs Parkway) as required by the Department of Public Works so as to

provide a total of 80 feet of right of way for N. Conant Avenue.

 

5. That the developer improve N. Conant Avenue to secondary arterial street standards as required by the Department of Public Works.

 

6. That the developer improve N.W. 101st Terrace (to be possibly renamed south of Building D) to secondary arterial street standards as required by the Department of

Public Works.

 

7. That the developer improve Tiffany Springs Parkway to parkway street standards as required by the Board of Parks and Recreation Commissioners.

 

8. That the developer construct sidewalks on both sides of Tiffany Springs Parkway as required by the Department of Public Works.

 

9. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

10. That the developer submit a street name signage plan for review and approval by the City Street Naming Committee (to possibly rename N.W. 101st Terrace south of

Building D).

 

11. That the developer comply with the Kansas City International Airport/Kansas City Downtown Airport height zoning restrictions for any structures and that this language

be included on the final plat.

 

12. That the developer grant a Noise and Aviation Easement for each phase to the City and file same with each final plat.

 

13. That the developer provide cross-access easements for each final plat as required by the Department of Public Works.

 

14. That the developer construct temporary cul-de-sacs on streets between phases as required by the Department of Public Works.

 

15. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working within any State right of way.

 

16. That the developer submit a traffic study to the Department of Public Works and the Missouri Highway and Transportation Department for approval to determine whether

construction upon Tract 2A will cause the need for signalization within the

interchange, and that the developer provide or assist with signalization as required by

the approved traffic study.

 

17. That the developer extend water mains as required by the Water Services Department.

 

18. That the developer extend sanitary sewers to serve each building with a separate service connection and that the developer relocate any structure proposed over

existing sanitary sewers or relocate the existing sanitary sewers as required by the

Department of Public Works.

 

19. That the developer provide for fire protection as required by the Fire Department.

 

20. That the developer submit a plan showing location and number of driveway and median crossings for approval by the Department of Public Works prior to issuance

of building permits.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 970657, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
