ORDINANCE NO. 961338

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 2 acre tract of land generally located on the west side of Wornall Road, approximately 400 feet south of W. 101st Terrace. (4613-CP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 2 acre tract of land generally located on the west side of Wornall Road, approximately 400 feet south of W. 101st Terrace, and more specifically described as follows:

 

A tract of land lying in the Northeast Quarter of Section 31, Township 48 North, Range 33 West, and also being a partial replat of Lot 5, Eden, according to the recorded subdivision thereof, in the City of Kansas City, Jackson County, Missouri, said tract being more particularly described as follows:

 

Commencing at the northeast corner of said Lot 5, Eden, thence South 02 15'03" West along the east line of said Lot 5 and the east line of said Northeast Quarter of Section 31, a distance of 336.73 feet; thence North 87 15'38" West, a distance of 50.00 feet to a point lying on the west right of way line of Wornall Road, and the point of beginning; thence South 02 15'03" West, along said west right of way line, a distance of 379.06 feet; thence North 87 19'38" West, a distance of 213.99 feet (214.00 feet platted) to a point lying on the west line of said Lot 5, Eden; thence North 02 15'03" East, along said west line a distance of 379.30 feet; thence South 87 15'38" East, a distance of 213.99 feet (214.00 platted) to the point of beginning and containing 81,140 square feet or 1.8627 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer provide fire protection as required by the Fire Department.

 

6. That the developer contribute $14,853.00 to the I-435/103rd Street Corridor Study Improvement Fund based on the rate of $7.30 per square foot for restaurant; $7.00

per square foot for drinking establishment; and $9.50 per square foot for fast service

restaurant.

 

7. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping and signage.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 961338, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
