ORDINANCE NO. 190848, AS AMENDED

 

Authorizing the City Manager to enter into a Project Management Agreement with the Kansas City Area Transportation Authority and the Kansas City Streetcar Authority for the Kansas City Streetcar Main Street extension project.

 

WHEREAS, the City of Kansas City, Missouri (the “City”), the Kansas City Streetcar Authority (the “KCSA”), and the Kansas City Area Transportation Authority (the “KCATA”) are currently affiliated and working cooperatively on the operation of the 2.2-mile Downtown Streetcar Line and have been working in partnership to support the planning, design, funding, staffing and operations of Main Street Extension Project (the “Project”); and

 

WHEREAS, it is the intent of the City, the KCSC and the KCATA to obtain federal funding for the Project through the Federal Transit Administration’s (the “FTA”) Capital Investment Grant program (“CIG”) under the New Starts qualification process; and

WHEREAS, on September 7, 2018, the City submitted a funding and rating request to the FTA, and in March 2019 received a Medium-High rating from the FTA; and

WHEREAS, the City, the KCSC and the KCATA intend to take the next step in the CIG process, which is to complete the Project Development Phase by December 2019, and obtain the FTA’s approval to enter into the Engineering Phase for the Project; and

WHEREAS, the City approved Committee Substitute for Ordinance No. 190510 on July 11, 2019, stating its intent to finance Project Local Funding in an amount not to exceed $185,000,000.00 through bond issuance or other financing vehicle and approving the immediate appropriation of $9,100,000.00 to be fully reimbursed by the Downtown Transportation Development District for furthering the engineering process within 3 years from the passage of Ordinance No. 190848, As Amended; and

WHEREAS, the City, the KCSC and the KCATA wish to establish roles and responsibilities of each party for the management and administration of the Project during Project Development, Engineering and Construction phases (the “Pre-Operations Phase”); and

WHEREAS, on September 25, 2019, the KCATA Board of Commissioners is expected to consider authorizing execution of a Project Management Agreement for the Pre-Operations Phase of the Project subject to similar actions by the City and KCSA; and

 

WHEREAS, on September 26, 2019, the KCSA Board of Directors is expected to consider authorizing execution of a Project Management Agreement for the Pre-Operations Phase of the Project subject to similar actions by the City and KCATA; and

 

WHEREAS, the City, the KCSC and the KCATA recognize the benefits of continuing the partnership and hope to further establish roles and responsibilities for the Project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute a Project Management Agreement with the Kansas City Area Transportation Authority and the Kansas City Streetcar Authority for the Kansas City Streetcar Main Street extension. A copy of the agreement is on file with the City Clerk’s office.
