ORDINANCE NO. 100530

 

Approving the Comprehensive Development Plan of the Port Authority of Kansas City, Missouri; approving and authorizing the City Manager to enter into an Agreement for the Transfer and Conveyance of Real Estate with the Port Authority regarding approximately 67.5 acres along the Missouri River west of the Paseo Bridge; and authorizing execution of other related documents.

 

WHEREAS, the Port Authority of Kansas City, Missouri (“Port Authority”) was established by the City Council of the City by virtue of Resolution No. 47523 duly adopted by the City Council on February 11, 1977, and is transacting business and exercising the powers granted to it as a port authority pursuant to Section 68.010, et seq., RSMo (“Act”), to promote the general welfare, encourage private capital investment and increase commerce within the port district; and

 

WHEREAS, Section 68.025 of the Act authorizes the Port Authority to enter into an agreement with the City of Kansas City, Missouri (“City”) to fulfill the purposes of the Port Authority, including accepting and receiving property and Section 68.030 of the Act authorizes the City to transfer and convey any property within the port district to the Port Authority, with or without consideration; and

 

WHEREAS, the City owns approximately 67.5 acres of real property along the Missouri River, in Kansas City, Jackson County, Missouri, being located generally between the harbor line on the south bank of the Missouri River on the north, property owned by the Authority, BNSF Railway Company and Kansas City Southern Railway Company on the south, the east right-of-way line of Delaware Street on the west and the Paseo Bridge on the east (the “City Parcels”); and

 

WHEREAS, the Port Authority owns approximately 17.5 acres of real property adjacent to the City Parcels (the “Port Authority Parcels”); and

 

WHEREAS, collectively, the City Parcels and the Port Authority Parcels are referred to as the “Riverfront Development Property;” and

 

WHEREAS, the Council finds that the further development of the City Parcels should be done as part of that certain Port Authority Comprehensive Development Plan as approved by the Board of Commissioners of the Port Authority, that such development can be achieved most effectively and efficiently by transferring the City Parcels to the Port Authority as permitted by Section 68.030 of the Act, and that, absent such transfer, the Port Authority will not be able to effectively negotiate with potential developers of the Riverfront Development Property to achieve the most benefit for the City, the Authority and the general public in fulfillment of the Authority’s purposes under the Act; and

 

WHEREAS, the Port Authority’s Comprehensive Development Plan, attached hereto, was finalized after review and comment by the City; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Comprehensive Development Plan for the Riverfront Development Property of the Port Authority of Kansas City, Missouri, is hereby approved.

 

Section 2. That the City Manager is hereby authorized, on behalf of the City, to execute the Agreement for the Transfer and Conveyance of Real Estate (the “Agreement”) with the Port Authority of Kansas City, Missouri, a copy of the agreement which is hereby approved and attached hereto in substantial form and by this reference made a part hereof.

 

Section 3. That the City Manager is further authorized and directed to execute on behalf of the City any other documents and instruments and to take all such other steps as are necessary to carry out the intent and purpose of this ordinance and the agreement.
