Title: Repealing the current Section 40-354, Code of Ordinances, entitled "Natural gas transportation fee" which was invalidated by the Missouri Supreme Court in the case of Armco Steel, et al. v. City of Kansas City, et al.; enacting a new Section 40-354, Code of Ordinances, entitled "Natural gas transportation fee" to impose on large users of natural gas obtained from non-franchised natural gas providers a fee of 10% of the cost of the natural gas purchased and transported to the City to provide a more equitable fee structure among those businesses and residential users and other businesses currently paying a natural gas fee; and submitting this ordinance to the voters for approval or disapproval at a special election to be held on August 5, 1997; directing the City Clerk to notify the responsible election authorities of the election being called; and recognizing this ordinance to be an emergency measure.
