COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 020209

 

Authorizing execution of a Lease Agreement with Transpec Leasing, Inc., for the use of City-owned property located at 3201 Nicholson Avenue, for the purpose of parking freight trailers, trucks and employee parking only.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of the Department of City Planning and Development is hereby authorized to execute a Lease Agreement with Transpec Leasing, Inc. for the leasing of City property generally located at 3201 Nicholson Avenue, Jackson County, Missouri, and more particularly described as follows:

 

A parcel of land in part of Lots 73, 74, and 75 of HURCKS SUBDIVISION OF GUINOTTE FARM, located in the southeast quarter of the southwest quarter of Section 27, Township 50, Range 33, in Kansas City, Jackson County, Missouri, being more particularly described as follows:

 

Commencing at a point on the south right of way line of Nicholson Avenue as it now exists where it intersects the northwest corner of said Lot 73; thence east 30 feet to the true point of beginning of the tract to be herein described; thence continuing south along a line west a distance of 365 feet; thence west 30 feet, thence south along west line of Lot 73 a distance of 360.86 ft to a point on the northerly right of way line of the Missouri Pacific Railroad as it now exists; thence continuing northeasterly along said northerly right of way line a distance of 631.06 feet to the southeast corner of Lot 75 of said subdivision; thence north along east line of Lot 75f a distance of 385.2 feet to a point on said line that is 350 feet south of the south line of Nicholson Avenue, as it now exists; thence west along a line drawn parallel to and 350 feet south of said south line of Nicholson Avenue a distance of 353.44 feet; thence north along a line drawn at right angles to the last described course a distance of 350 ft. to a point on the south right of way line of Nicholson Avenue; thence west along said right of way line a distance of 251.44 feet to the point of beginning.

 

Lessee has the right to use a strip of land along the west side of Lot 73, beginning at the northwest corner of said lot, thence proceeding south along said west line a distance of 565.0 feet; thence easterly at right angles to said west line a distance of 30.0 feet; thence northerly at right angles, and parallel to said west line, a distance of 565.0 feet, to a point on the south right of way line, of Nicholson Avenue, as it now exists; thence westerly along said right of way line a distance of 30.0 feet to the point of beginning, for ingress and egress to the described property, to be used for the purpose of parking freight trailers, trucks and employee parking only, for a term of five years with an option to renew for another five years, beginning April 1, 2002 and ending March 31, 2007, at a rental rate of $25,200.00 modified by the Consumer Price Index each year plus $100.00 per month. A copy of the Lease Agreement is attached hereto and made a part hereof by reference
