COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 021298

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0444, rezoning an area of approximately 14.7 acres generally located at the northeast corner of 69th Street and Holmes Road from District R-2a (Two-Family Dwellings) to District PD/R-2a (Planned District/Two-Family Dwellings), and approving a development plan for the same. (8889-PD-16)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0444, rezoning an area of approximately 14.7 acres generally located at the northeast corner of 69th Street and Holmes Road from District R-2a (Two-Family Dwellings) to District PD/R-2a (Planned District/Two-Family Dwellings), said section to read as follows:

 

Section 80-11A0444. That an area legally described as:

 

All or part of Lot 2, Baptist Medical Center - Third Plat, and all or part of Lots 1, 2, 3, 4, 15, 16, 17 and 18, Shryock Heights, each being a recorded subdivision in the City of Kansas City, Jackson County, Missouri, according to the recorded plat thereof, together with that portion of vacated 68th Street, the north half of vacated 69th Street and vacated Campbell Street which lies south of 68th Street and north of the centerline of vacated 69th Street, all being in the Northeast Quarter of the Northeast Quarter of Section 8, Township 48 North, Range 33 West, in said city, county and state; being more particularly described as follows:

 

Beginning at the most east, southeast corner of said Lot 2, Baptist Medical Center - Third Plat, being a point on the northerly right of way line of 68th Street, as now established, 30 feet north of the centerline of said 68th Street; thence South 02E20'28" West (South 02E16'54" West, Plat) along the southerly prolongation of the easterly line of said Lot 2, a distance of 6.37 feet to a point on the northerly right of way line of said 68th Street, as now established, said point being 25 feet north of the centerline of said 68th Street; thence South 36E43'20" East along a radial line to said centerline, a distance of 25.00 feet to a point on the centerline of said 68th Street; thence southwesterly along the centerline of said 68th Street, along a curve to the left having an initial tangent bearing of South 53E16'40" West, a radius of 125.00 feet and a central angle of 31E38'57", an arc length of 69.05 feet; thence South 68E22'17" East along a radial line to the last described curve, a distance of 25.00 feet to a point on the southerly right of way line of said 68th Street, being also the point of intersection of the easterly right of way line of said vacated Campbell Street with the westerly line of said Lot 4, Shryock Heights; thence southwesterly and southerly along the easterly right of way line of said vacated Campbell Street and along the westerly line of said Lot 4, along a curve to the left, having an initial tangent bearing of South 21E37'43" West, a radius of 100.00 feet and a central angle of 19E04'00", an arc distance of


33.28 feet; thence South 02E33'43" West along said easterly and westerly lines, tangent to the last described curve, a distance of 12.73 feet, more or less, to a point that is 291.9 feet north of the southerly line of said Lot 4; thence South 86E42'48" East along a line which is 291.9 feet north of and parallel with the southerly line of said Lot 4, a distance of 154.22 feet (152.93 feet, Deed), more or less to a point that is 100.00 feet west of the easterly line of said Lot 4; thence South 02E20'07" West along a line which is 100.00 feet west of and parallel with the easterly line of said Lot 4, a distance of 90.01 feet (90 feet, Deed), more or less to a point that is 201.9 feet north of the southerly line of said Lot 4; thence South 86E42'48" East along a line which is 201.9 feet north of and parallel with the southerly line of said Lot 4, a distance of 100.01 feet, more or less, to a point on the easterly line of said Lot 4; thence South 02E20'07" West along the easterly line of said Lot 4, a distance of 201.93 feet, more or less to a point on the northerly line of said Lot 2, Shryock Heights; thence South 86E42'48" East along the northerly line of said Lot 2 and said Lot 1, Shryock Heights, a distance of 182.91 feet, more or less, to a point that is 8.00 feet east of the northwest corner of said Lot 1, as measured perpendicular to the westerly line of said Lot 1; thence South 02E23'09" West along a line which is 8.00 feet east of and parallel with the westerly line of said Lot 1, a distance of 219.65 feet to a point on the centerline of said vacated 69th Street; thence North 86E45'37" West along the centerline of said vacated 69th Street, a distance of 951.64 feet, to a point on the easterly right of way line of 69th Street, as now established; thence North 02E21'37" East along said easterly right of way line, a distance of 25.00 feet, to a point on the northerly right of way line of said 69th Street, being also a point on the southerly line of said Lot 17, Shryock Heights; thence North 86E45'37" West along the northerly right of way line of said 69th Street, being also the southerly line of said Lot 17, a distance of 81.78 feet; thence westerly and northwesterly along said northerly and southerly lines, along a curve to the right, tangent to the last described course, having a radius of 50.00 feet and a central angle of 52E15'02", an arc distance of 45.60 feet to a point on the easterly right of way line of Holmes Road, as now established, 10 feet east of and parallel with the westerly line of said Lots 17 and 18, Shryock Heights; thence North 02E21'37" East along the easterly right of way line of said Holmes Road, a distance of 355.90 feet to a point on the southerly right of way line of said 68th Street, as now established, being also a point on the northerly line of said Lot 18; thence northeasterly along said southerly and northerly lines, along a curve to the right, having an initial tangent bearing of North 39E13'48" East, a radius of 50.00 feet and a central angle of 19E04'27", an arc length of 16.65 feet to the point of intersection of the southerly prolongation of the westerly line of said Lot 2, Baptist Medical Center - Third Plat, with the southerly right of way line of said 68th Street; thence North 02E21'37" East (North 02E18'03" East, Plat) along said southerly prolongation, a distance of 88.64 feet to the most west, southwest corner of said Lot 2, being also the point of intersection of the northerly right of way line of said 68th Street with the easterly right of way line of said Holmes Road; thence continuing North 02E21'37" East (North 02E18'03" East, Plat) along the westerly line of said Lot 2 and along the easterly line of said Holmes Road, a distance of 343.39 feet; thence South 87E38'23" East, perpendicular to the last described course, a distance of 122.20 feet; thence South 02E35'18" West, 106.40 feet; thence South 87E24'42" East, a distance of 507.09 feet to a point on the easterly line of said Lot 2; thence South 02E20'28" West (South 02E16'54" West, Plat) along the easterly line of said Lot 2, a distance of 97.96 feet to the point of beginning. Containing 638,922 square feet or 14.668 acres, more or less.

 

is hereby rezoned from District R-2a (Two-Family Dwellings) to District PD/R-2a (Planned District/Two-Family Dwellings), all as shown outlined on a map marked Section 80-11A0444, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Public Works Department prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre, including providing security equal to the estimated cost to install and maintain the approved erosion and sediment control measures for the duration of the land disturbance permit.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five (5) acres.

 

6. That the developer dedicate additional right of way for Holmes Road as required by the Board of Parks and Recreation Commissioners so as to provide 52 feet of right of way as measured from the centerline of Holmes Road.

 

7. That the developer improve the east half of Holmes Road to boulevard standards as required by the Board of Parks and Recreation Commissioners, including repair and/or construction of curb, gutter, and sidewalks and installation of streetlights.

 

8. That the developer dedicate right of way for relocated 68th Street as required by the Department of Public Works so as to provide 53 feet of right of way as measured from the centerline of relocated 68th Street..

 

9. That the developer construct relocated 68th Street to collector street standards as required by the Department of Public Works, including construction of curb, gutter, and sidewalks on one side, storm sewers and installation of streetlights.

 

10. That the developer contribute $35,000.00 for the construction of a sidewalk on one side of 68th Street from the east plan boundary to Troost Avenue as required by the Department of Public Works..

 

11. That the developer make any street improvements required by the traffic study as required by the Department of Public Works.

 

12. That the developer design interior streets to City standards as required by the Department of Public Works.

 

13. That the developer extend and/or relocate sanitary and/or storm sewers as required by the Department of Public Works.

 

14. That the developer extend and/or relocate water mains as required by the Water Services Department.

 

15. That the developer petition for the vacation of 68th Street.

 

16. That the developer receive the approval of the Board of Zoning Adjustment for a variance to the maximum building height and to allow parking in the front yard.

 

17. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owners prior to submitting any public improvements.

 

18. That the developer request the Public Works Department to initiate an ordinance to establish or reestablish the grade on 68th Street if the grade is to be either lowered or raised.

 

19. That streetlights for proposed 68th Street be integrated into the existing streetlight system as required by the City Engineers Office.

 

20. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, including canopy shade trees a maximum of 40 feet on center along Holmes Road, signage (including elevations), lighting (including a photometric study showing no direct illumination beyond the property lines), detention basin details and building elevations.

A copy of said development plan is on file in the office of the City Clerk under Document No. 021298, which is attached hereto and made a part hereof.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
