COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050598

 

Rezoning an area of approximately 1.1 acres generally located on the west side of Roanoke Road between 41st Place and 42nd Street from District R-5 to District PD/R-5 and approving a development plan for the same. (13357-PD-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0631, rezoning an area of approximately 1.1 acres generally located on the west side of Roanoke Road between 41st Place and 42nd Street from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments), said section to read as follows:

Section 80-11A0631. That an area legally described as:

 

All of Lots 1, 2 and 3, Greggs Place, a subdivision in Kansas City, Jackson County, Missouri, along with the 7 foot vacated alley lying North of and adjacent to said lots and all that part of Lot 15, Louis Vogels Third Addition, a subdivision in Kansas City, Jackson County, Missouri, being described as follows: Beginning at the Southeast corner of said Lot 1; thence South 683257 West, along the South line of said Lots 1, 2 and 3, 150.00 feet to the Southwest corner of said Lot 3; thence North 210920 West, along the West line of said Lot 3 and its prolongation North, 142.91 feet to a point on the South line of Lot 15, said Louis Vogels Third Addition; thence South 683257 West, along the South line of said Lot 15, 50.00 feet; thence North 210920 West, 130.00 feet to a point on the South right-of-way line of 41st Place, as now established; thence North 683257 West, along said South right-of-way line, 200.00 feet to a point on the East line of said Lot 15; thence South 210920 East, along said East line and the East line of said Lot 1 and its North prolongation, 272.91 feet to the point of beginning.

 

is hereby rezoned from District R-5 (High Apartments) to District PD/R-5 (Planned District/High Apartments) all as shown outlined on a map marked Section 80-11A0631, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer shall secure permits to repair sidewalks, curbs, and gutters as necessary along all development frontages as required by the Department of Public Works in accordance with Chapters 56 and 64 of the Code, prior to recording the plat.

 

3.                  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas and private open space tracts.

 

4.                  That the developer provide for fire protection as required by the Fire Department.

 

5.                  That the developer submit a final plan to the City Plan Commission for approval prior to the issuance of a building permit. The site plan shall include information regarding property uses, setback distances, lighting, landscaping and architectural characteristics, berms, trees and planting around and within the parking lots, show proposed pedestrian circulation and include elevation drawings of buildings and signage.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
