Approving a development plan in
District B3-3 on about 7 acres generally located at southeast corner of Missouri
Route 152 and N. Green Hills Road to allow for 22,000 square foot office/
retail development on four (4) lots. (14466-P-1)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That a
development plan in District B3-3 (Community Business dash 3) on about 7 acres
generally located at southeast corner of Missouri Route 152 and N. Green Hills
Road, and more specifically described as follows:
A
tract of land in the Northeast Quarter of Section 8, Township 51, Range 33,
Kansas City, Platte County, Missouri, described as follows: Commencing at the
Northwest corner of said Northeast Quarter; thence South 00 degrees 25 minutes
54 seconds West, along the West line of said Northeast Quarter, 347.37 feet
thence South 88 degrees 55 minutes 51 seconds East, parallel with the North
line of said Northeast Quarter 99.42 feet to a point on the East right-of-way
line of N. Green Hills Road, said point being the Point of Beginning of the
tract to be described herein; thence South 88 degrees 55 minutes 51 seconds
East continuing along said line, 527.58 feet to the West line of Ramona Villa,
a subdivision in said Kansas City, Platte County, Missouri; thence South 00
degrees 25 minutes 54 seconds West, along said line 252.63 feet to the
Southwest corner of said Ramona Villa; thence North 88 degrees 55 minutes 49
seconds West, along the Westerly prolongation of the South line of said Ramona
Villa, 127.37 feet; thence South 12 degrees 26 minutes 38 seconds West, 348.94
feet; thence South 00 degrees 25 minutes 54 seconds West, parallel with the
West line of said Northeast Quarter, 100.00 feet; thence North 88 degrees 55
minutes 51 seconds West, parallel with the North line of said Northeast
Quarter, 347.00 feet to the East right-of-way line of said N. Green Hills Road;
thence North 00 degrees 25 minutes 54 seconds East, 80.00 feet from and
parallel with the centerline thereof, 35.10 feet to a point 80.00 feet left of
centerline Station 32+00; thence North 06 degrees 08 minutes 32 seconds East,
continuing along said right-of-way line, 100.50 feet to a point 90.00 feet left
of centerline station 31+00; thence North 00 degrees 25 minutes 54 seconds
East, continuing along said line 90.00 feet from and parallel with the
centerline thereof, 500.00 feet; thence North 09 degrees 25 minutes 52 seconds
East, continuing along said right-of-way line, 60.16 feet to the point of
beginning, subject to that part, if any, in streets, roadways, highways or
other public right-of-ways.
is hereby approved, subject to
the following conditions:
1.
That the developer submit an architectural design guideline that calls
out preferred materials and façade elevations for the overall development per
staff approval prior to issuance of building permit.
2.
That the developer construct the trail connection to the existing 152
trail to the north as part of the initial site disturbance and grading for the
proposed detention facility. This should occur with the issuance of the first
building permit for this development.
3.
That the developer submit a street tree planting plan with the final
plat and plat trees in accordance with the plan. The developer shall also secure
the approval of the City Forester for street trees to be planted in the right
of way prior to Mylar approval of this final plat.
4.
That the developer cause the area to be platted and processed in
accordance with Chapter 88, Code of Ordinances of the City of Kansas City,
Missouri.
5.
That the developer submit a macro "overall" storm drainage
analysis from a Missouri-licensed civil engineer for the entire development in
accordance with adopted standards to the Land Development Division for review
and acceptance at the time the first plat is submitted, with a micro
"detailed" storm drainage study, including a BMP level of service
analysis, in accordance with current adopted standards to be submitted for each
phase at the time of final platting, and the developer secure permits to
construct any improvements required by the Land Development Division prior to
recording the plat.
6.
That the developer verify vertical and horizontal sight distance for the
drive connection to N. Green Hills Road and make improvements to ensure local
jurisdiction and/or minimum AASHTO adequate sight distance standards are met.
7.
That the developer pay impact fees as required by Chapter 39 of the
City's Code of Ordinances as required by the Land Development Division.
8.
That the developer submit a letter to the Land Development Division from
a licensed civil engineer, licensed architect, or licensed landscape architect,
who is registered in the State of Missouri, identifying sidewalks, curbs, and
gutters in disrepair as defined by Public Works Department's "OUT OF
REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB revised 4/8/09" and based
on compliance with Chapters 56 and 64, Code of Ordinances, for the sidewalks,
curbs, and gutters where said letter shall identify the quantity and location
of sidewalks, curbs, and gutters that need to be constructed, repaired, or
reconstructed to remedy deficiencies and/or to remove existing approaches no
longer needed by this project. The developer shall secure permits to repair or
reconstruct the identified sidewalks, curbs, and gutters as necessary along all
development street frontages as required by the Land Development Division and
prior to issuance of any certificate of occupancy permits including temporary
certificate of occupancy permits.
9.
That the developer obtain the executed and recorded City approved
grading, temporary construction, drainage/sewer, or any other necessary
easements from the abutting property owner(s) that may be required prior to
submitting any public improvements crossing properties not controlled by the
developer and include said document(s) within the public improvement
applications submitted for permitting.
10.
That the owner/developer submit plans for grading, siltation, and
erosion control to the Land Development Division for review and acceptance, and
secure a site disturbance permit for any proposed disturbance area equal to one
acre or more prior to beginning any construction activities.
11.
That the developer grant a BMP Easement to the City as required by the
Land Development Division, prior to obtaining any certificate of occupancy for
any building permit.
12.
That the developer grant a Surface Drainage Easement to the City as
required by the Land Development Division for the drainage channel on the
eastern portion of the property, prior to recording the plat.
13.
That the developer enter into a covenant agreement for the maintenance
of any stormwater detention area tracts as required by the Land Development
Division, prior to recording the plat.
14.
That the developer is allowed the median break on Green Hills Road for
Drive 1 (north drive at Lot 4), located approximately 720 feet south of the
existing centerline of Highway Missouri 152, with
extended left turn storage.
15.
That the developer contribute 50% for the traffic signal at Drive 2
(south drive at Lots 2 and 3), in the amount of $137,000.00, when the first
building permit for this site is pulled.
16.
That the Developer is not required to install dual southbound left turns
at the intersection of Highway Missouri 152 eastbound ramps and Green Hills
Road.
A copy of said development plan
is on file in the office of the City Clerk which this ordinance and is made a
part hereof.
Section B. That the Council finds and
declares that before taking any action on the proposed amendment hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
