RESOLUTION NO. 071219

 

Amending the South Central Area Plan in an area of approximately 1.9 acres generally located on the east side of Troost Avenue between E. 57th Street and E. 58th Street by changing the recommended land use designation from retail commercial uses to medium density residential uses. (249-S-9)

 

WHEREAS, on March 21, 1980, the City Council by adoption of Resolution No. 51319 adopted the South Central Area Plan being the plan for development and redevelopment of that area bounded by Volker/47th Street on the north, 63rd Street on the south, Prospect Avenue on the east and Oak Street on the west; and

 

WHEREAS, said South Central Area Plan was amended on June 18, 1989, through the adoption of Committee Substitute for Resolution No. 63221; was again amended on November 30, 1989, through the adoption of Resolution No. 64742; was amended on November 6, 1997, through the adoption of Resolution No. 971077; was amended on February 11, 1998, through the adoption of Resolution No. 981498; was amended on March 18, 1999, through the adoption of Resolution No. 990137; was amended on July 12, 2001, through the adoption of Resolution No. 010947; was amended on November 7, 2002, through the adoption of Resolution No. 021247; and was further amended on January 8, 2004 through the adoption of Resolution No. 031325; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the South Central Area Plan as it affects approximately 1.9 acres generally located on the east side of Troost Avenue between E. 57th Street and E. 58th Street by changing the recommended land use designation from retail commercial uses to medium density residential uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on October 1, 2007; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on October 16, 2007; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on October 16, 2007, recommend approval of the proposed amendment to the South Central Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the South Central Area Plan is hereby amended in an area of approximately 1.9 acres generally located on the east side of Troost Avenue between E. 57th Street and E. 58th Street by changing the recommended land use designation from retail commercial uses to medium density residential uses. A copy of said amendment to the South Central Area Plan is attached hereto as Exhibit "A" and incorporated herein by reference.

 

Section B. That the amendment to the South Central Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the zoning ordinance have been given and had.
