ORDINANCE NO. 940000
Amending Chapter 65, Revised Ordinances of Kansas City,
Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section
to be known as Section 65.010A2497, rezoning an area of approximately 13.9
acres generally located at the southwest corner of U.S. Highway 169 and N.W.
Cookingham Drive from Districts R-1a (One-Family Dwellings) and CP-2 (Local
Planned Business Center) to District CP-2 (Local Planned Business Center), and
approving a preliminary plan for the same. (10874-CP-2)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 65, Revised Ordinances of
Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby
amended by enacting a new section to be known as Section 65.010A2497, rezoning
an area of approximately 13.9 acres generally located at the southwest corner
of U.S. Highway 169 and N.W. Cookingham Drive from Districts R-1a (One-Family
Dwellings) and CP-2 (Local Planned Business Center) to District CP-2 (Local
Planned Business Center), said section to read as follows:
Section 65.010A2497. That an area legally described
as:
All that part of the Southeast Quarter of Section
22, Township 52, Range 33, Kansas City, Clay County, Missouri, being
bounded and described as follows: Commencing at the northwest corner of
said Southeast Quarter; thence South 8947'55" East along the north
line of said Southeast Quarter, 820.35 feet; thence South 012'05"
West, 30.00 feet to the true point of beginning, said point also being a
point on the south right of way line of State Highway Route 291, as now
established; thence South 8947'55" East along said right of way
line, 572.19 feet; thence South 7445'08" East along said right
of way line 269.64 feet; thence South 8947'55" East along said
right of way line, 139.60 feet; thence South 4434'28" East along
said right of way line, 140.15 feet to a point on the westerly right of
way line of N.W. Arrowhead Trafficway, (U.S. Highway No. 169), as now
established; thence South 041'11" West along said right of way line,
412.72 feet; thence southerly along a curve to the left, tangent to the
last described course, having a radius of 490.00 feet, an arc
distance of 12.81 feet; thence North 8947'55" West, 1,067.47 feet;
thence North 012'05" East, 595.00 feet to the point of beginning.
Containing 13.91 acres, more or less.
is hereby rezoned from Districts R-1a (One-Family
Dwellings) and CP-2 (Local Planned Business Center) to District CP-2 (Local
Planned Business Center), all as shown outlined on a map marked Section
65.010A2497, which is attached hereto and made a part hereof, and which is
hereby adopted as a part of an amendment to the zoning maps constituting a part
of said chapter and as an amendment to Section 65.010 thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 31, Code of General
Ordinances of Kansas City, Missouri, as
amended, commonly
known as the Subdivision Regulations.
2. That the developer dedicate additional right of
way as required for a total right of way of 50 feet as measured
from the centerline of N.W. Cookingham Drive.
3. That the developer improve N.W. Cookingham
Drive to arterial street standards.
4. That the developer submit a storm drainage
study to the City Engineer's Office for approval.
5. That the developer submit plans for grading and
siltation and erosion control to the City Engineer for approval
prior to the commencement of any construction.
6. That the developer obtain a land disturbance
permit from the Missouri Department of Natural Resources.
7. That the developer receive the approval of the
Missouri Highway and Transportation Department for any work within
State right of way.
8. That the developer extend water mains as
required by the Water Department.
9. That the developer receive the approval of the
Street Naming Committee for all street names.
10. That the developer receive the approval of the
Director of the Department of Public Works for the locations of
intersections or drives.
11. That the developer submit a final plan for
approval which provides the following:
a. Pedestrian access between residential and
commercial uses and between commercial buildings;
and
b. Screening, extensive landscaping, and
berming
between commercial and residential uses;
and
c. Landscaped median with the collector
street as it
intersects with N.W. Cookingham Drive; and
d. Landscaping within parking islands; and
e. Signage will be restricted to monument and
flatwall/fascia signs.
A copy of said preliminary plan is on file in the office
of the City Clerk under Document No. 940000, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
