COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060770

 

Approving the First Amendment to the General Development Plan for the Washington 23 Area by expanding the area to include an area of approximately 2 acres generally located on the east side of Broadway between the Kansas City Terminal Railway on the south and 21st Street on the north; declaring the additional area of approximately 2.0 acres to be a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Planned Industrial Expansion Authority law; finding the First Amendment to be in compliance with Sections 100.300-100.620, RSMo; and approving the ad valorem tax benefits therefore.

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, (the Authority) found that the Washington 23 Area to be blighted pursuant to the PIEA Law and recommended to the City Council that said area be designated as a blighted, insanitary or underdeveloped industrial area defined by Section 100.310 (2, 11 and 18), RSMo; and

 

WHEREAS, said area was declared to be blighted by the City Council through passage of Committee Substitute for Ordinance No. 050412 on April 28, 2005, and a General Development Plan was approved for the area known as the Washington 23 General Development Plan; and

 

WHEREAS, on May 22, 2006, the Authority adopted Resolution No. 1103 accepting the Amended Blight Study for the PIEA area and finding the additional area of approximately 2.0 acres located on the east side of Broadway between the Kansas City Terminal Railway on the south and 21st Street on the north to be blighted, insanitary or underdeveloped industrial area defined by Section 100.310 (2, 11 and 18), RSMo, and approving the First Amendment to the General Development Plan for the Washington 23 Plan Area;

 

WHEREAS, the City Plan Commission reviewed and recommended approval of the First Amendment to the General Development Plan for the Washington 23 Area on July 18, 2006, and has found said plan to be in conformance with the general plan for development of the community as a whole; and

 

WHEREAS, Section 100.400, RSMo, authorizes the Council to approve a general development plan after a designation of blight if the Council finds the plan is feasible and in conformity with the general plan for the redevelopment of the community as a whole; and

WHEREAS, the Council has determined that ad valorem tax exemption benefits as authorized by Section 100.570, RSMo, are necessary to attract developers to the additional area of the Washington 23 Plan Area; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council declares the additional area of approximately 2 acres generally located on the east side of Broadway between the Kansas City Railway Terminal on the south and 21st Street on the north, and more specifically described as follows:

 

2101 Broadway: Tract 1: Lots 1, 2, 3, and 4, Block 25, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

2109-15 Broadway: Tract 2: Lots 5, 6, 7 & 8 Block 25, Goodrich Addition;

2117 Broadway: Tract 1: All of Lots 9 thru 16 inclusive, in Block 25 of Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

Tract 2: The Old Milwaukee Yard Subdivision, a subdivision in the Kansas City, Jackson County, Missouri according to the Boundary survey recorded September 11, 2003 as Document No. 2003K-0071218 in Book 8 Page 93, being a survey of the Old Milwaukee Yard Subdivision recorded February 27, 1998 as Document No. K-98009429, in Book 39 Page 84, Except the following described tract: A part of Lot 1, the Old Milwaukee yard Subdivision, a subdivision in Kansas City, Jackson County, Missouri according to the Boundary Survey recorded as document Number 2003K-0071719 on September 11, 2003, in Book 8 Page 93, at the Recorder of Deeds Office in Jackson County, Missouri being more particularly described as follows: Commencing at the Southwest corner of said Lot 1, said point being the Point of Beginning of the herein described tract; thence North 28 degrees 47 minutes 59 seconds West, a distance of 94.62 feet to a point on the North line of said Lot 1, said point also being on the South Right-of-way line of 22nd Street; thence North 61 degrees 12 minutes 01 seconds East, along the North line of said Lot 1 and said South Right-of-way line, a distance of 57.88 feet to the northeast corner of said Lot 1; thence South 02 degrees 39 minutes 22 seconds West along the East line of said Lot 1 a distance of 110.92 feet (Plat = 113.41 feet) the Point of Beginning.

 

Tract 3: A tract of land located in the Northwest Quarter of Section 8, Township 49 North, Rand 33 West, in Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the Southwest corner of the Northwest Quarter of Section 8, Township 49 North, Range 33 West; thence South 87 degrees 16 minutes 20 seconds East along the South line of said Northwest quarter, a distance of 40.14 feet to a point on the Southeasterly line of Lot 1, The Old Milwaukee Yard Subdivision, a subdivision in Kansas City, Jackson County, Missouri, according to the Boundary Survey recorded as Document No. 2003K-0071218, on September 11, 2003, in Book 8 Page 93, at the Recorder of Deeds Office in Jackson County, Missouri, said point being the Point of Beginning of the herein tract; thence North 53 degrees 22 minutes 14 seconds East along the Southeasterly line of said Lot 1, a distance of 152.86 feet to the beginning of a curve concave to the Southeast, having a radius of 913.00 feet; thence Northeasterly along the Southeasterly line of said Lot 1, 114.53 feet along a curve through a central angle of 07 degrees 10 minutes 19 seconds to the Southeast corner of said Lot 1; thence South 28 degrees 47 minutes 59 seconds East, a distance of 38.21 feet; thence South 61 degrees 09 minutes 24 seconds West, a distance of 250.73 feet, to a point on the South line of the Northwest Quarter of said Section 8; thence North 87 degrees 16 minutes 20 seconds West along said South line a distance of 17.41 feet to the Point of Beginning; and

 

All that part of the east 40 feet of Broadway Boulevard lying north of the south line of the north half of Section 8, Township 49 North, Range 33 West, and lying south of the following described line: Commencing at the southwest corner of Lot 16, Block 25, Goodrich Addition, said point also being on the east right of way of said Broadway Boulevard; thence N 022728 E along said east right of way line a distance of 73.02 feet to the point of beginning of said line; thence N 873232 W a distance of 40 feet to the centerline of said Broadway Boulevard, said point being the terminus of said line; except a 50 foot strip of said Broadway Boulevard being 25 feet on each side of the following described centerline: commencing at the southwest corner of said Lot 16; thence S 022728 W along the southerly prolongation of the west line of said Lot 16 a distance of 23.39 feet to the point of beginning of said centerline; thence S 611201 W along said centerline a distance of 11.20 feet to the beginning of a curve concave to the southeast having a radius of 98.67 feet; thence southwesterly 66.11 feet along said curve through a central angle of 382318; thence S 224843 W along said centerline a distance of 49.45 feet to the beginning of a curve concave to the northwest having a radius of 101.33 feet; thence southwesterly 25.76 feet along said curve through a central angle of 143402 to the west right of way line of said Broadway Boulevard as it now exists, said point being the terminus of said centerline, all in Section 8, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri

 

to be a blighted, insanitary or undeveloped industrial area in need of industrial development as defined in Section 100.310, RSMo, which constitutes an economic or social liability or a serious and growing menace, which is injurious to the public health, safety, morals, economy and welfare of the residents of Kansas City, and finds that the elimination or prevention of the detrimental conditions in such area by the commercial development of such area is necessary and in the interest of the public health, safety, morals, economy and welfare of such residents.

 

Section 2. That the First Amendment to the General Development Plan for the Washington 23 Plan Area, as shown in the First Amendment to the General Development Plan dated May 22, 2006, and described herein, by including the said additional area of approximately 2.0 acres, is hereby approved. A copy of said First Amendment to the General Development Plan for the Washington 23 Plan Area is attached hereto and incorporated herein by reference with this ordinance.

 

Section 3. That this Council has duly made the findings necessary for compliance with Sections 100.300 through 100.620, RSMo.

 

Section 4. That said First Amendment to the General Development Plan for the Washington 23 Plan Area is hereby found to be feasible and in conformance with the general development plan for the community as a whole.

 

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the plan area, as amended by the First Amendment, to the extent and in the manner provided for in said First Amendment to the General Development Plan for the Washington 23 Plan Area, subject to the execution of a development agreement with the Authority.
