ORDINANCE NO. 090092

 

Approving an amendment to previously approved preliminary development plan District CP-1 on an approximately 1.89 acre tract of land generally located at the southwest corner of N. Cypress Avenue and N.E. Vivion Road. (5200-CP-13)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary development plan in District CP-1 (Neighborhood Planned Business Center) on approximately a 1.89 acre tract of land generally located at the southwest corner of N. Cypress Avenue and N.E. Vivion Road, and more specifically described as follows:

 

Lot 1, Teleford Manor Resurvey, a subdivision in Kansas City, Missouri;

 

Lot 1, Lucas Plaza, a subdivision in Kansas City, Missouri; and

 

Lot 1 Midwest Jewelers Replat, a subdivision in Kansas City, Missouri.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to review and issuance of any building permits, and that the developer construct any improvements as required by Development Services prior to issuance of any certificate of occupancy.

 

2.                  That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer be responsible for all costs associated with subordination activities.

 

3.                  That the applicant receive any necessary variances from the Board of Zoning Adjustment

 

4.                  That the developer dedicate additional right of way by general warranty deed for a primary arterial with a bike lane as required by Development Services so as to provide a minimum of 56 feet of right of way as measured from the centerline of Vivion Road, prior to issuance of any certificate of occupancy.

 

5.                  That the developer submit a letter from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The letter must identify state of repair as defined in Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to issuance of any certificate of occupancy.

 

6.                  That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, signage, grading, building elevations and photometric study showing zero footcandles at the property lines.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been held as required by the Zoning Ordinance.
