Approving
the preliminary plat of Mt. Cleveland Estates on an approximately 1 acre tract
of land generally located on the south side of E. 53rd Street between Cleveland
Avenue and Myrtle Avenue. (SD 1069)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That the preliminary plat of Mt. Cleveland Estates on an approximately 1
acre tract of land generally located on the south side of E. 53rd Street
between Cleveland Avenue and Myrtle Avenue, and more specifically described as
follows:
This is a resurvey and subdivision of part of
Lot 4, Mount Cleveland, a subdivision in the Northeast 1/4 of the Northeast 1/4
of Section 34, Township 49 North, Range 33 East, in the City of Kansas City,
Jackson County, Missouri, more particularly described as follows: Commencing
at the northwest corner of said Northeast 1/4 of said Northeast 1/4; thence
South 87E3143 East along the
centerline of East 53rd Street, being also the north line of said 1/4 1/4
Section as established by control in said Lot 4, Mount Cleveland, and Mount
Cleveland Homes, a subdivision in said city, county and state, a distance of
231.29 feet; thence South 2E4057
West and parallel to the west line of said 1/4 1/4 Section, a distance of 30.00
feet to the northwest corner of the east 400 feet of said Lot 4, said point
being also 191.29 feet East (191.32 feet Deeds) of the northwest corner of said
Lot, said point being also the true point of beginning of this tract; thence
South 87E3143 East along the
south line of said 53rd Street and the north line of said Lot 4, a distance of
319.30 feet (320 feet Deeds) to the northwest corner of the east 80.00 of said
Lot 4; thence South 2E3640 West along the
west line of said east 80 feet, a distance of 135.11 feet (134.84 feet Deed) to
a point on the north line of the south 164.55 feet (also deeded as 164.5 feet)
of said Lot 4; thence North 87E2500
West along said north line, a distance of 319.47 feet (320 feet Deeds) to the
west line of said east 400 feet of said Lot 4; thence North 2E4057 East along said west line, a
distance of 134.48 feet (134.85 feet Deed) to the point of beginning. The
above tract contains 43.051 square feet or 0.9883 acres, more or less.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly
known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer construct any improvements as required by the
City Engineer's Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources if the disturbed area of the entire development exceeds one
acre.
5. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
6. That
the developer secure permits to construct or reconstruct sidewalks, curb and
gutters on the south side of E. 53rd Street along the project frontage prior to
recording of the plat as required by the Department of Public Works.
7. That
any streetlights relocated as part of the development be integrated into the
existing street light system as required by the Department of Public Works.
8. That
the developer construct sanitary and/or storm sewers and determine adequacy as
required by the Department of Public Works.
A
copy of the preliminary plat is on file in the office of the City Clerk under
Document No. 040152, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed preliminary plat hereinabove, all public notices and hearings required
by the Subdivision Regulations have been given and had.
