COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970197

 

Approving the preliminary plat of Clayton Meadows, West, on a 45.6 acre tract of land generally located on both sides of N. Bell Street, extended to intersect with N.W. Waukomis Drive. (SD 0445L)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Clayton Meadows, West, on a 45.6 acre tract of land generally located on both sides of N. Bell Street, extended to intersect with N.W. Waukomis Drive, and more specifically described as follows:

 

A parcel of land in part of the South 1/2 of the Northeast 1/4 of Section 28, Township 51 North, Range 33 West, in Kansas City, Platte County, Missouri, being more particularly described as follows: Beginning at the southeast corner of said Northeast 1/4 of Section 28; thence North 89 08'33" West, along the south line of said Northeast 1/4 of Section 28, 1283.63 feet to a point on the easterly right of way line of Missouri State Highway AA, as now established; thence northwesterly, along said easterly right of way line, on a curve to the left having a radius of 5,762.58 feet and an initial tangent bearing of North 16 02'25" West, 442.73 feet to a point of tangency; thence North 20 26'32" West, continuing along said easterly right of way line, 952.77 feet to a point on the north line of said South 1/2 of the Northeast 1/4 of Section 28; thence South 89 20'37" East, along said north line of said South 1/2 of the Northeast 1/4 of Section 28, 1766.83 feet to the northeast corner of said South 1/2 of the Northeast 1/4 of Section 28; thence South 00 31'12" West, along the east line of said Northeast 1/4 of Section 28, 1312.17 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval with the first plat and that the developer make any

necessary improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

5. That a variance of the maximum allowable lot width to depth ratio for those single family lots in excess of 1:3 is hereby granted.

 

6. That the developer secure the approval of the Board of Zoning Adjustment for any subdivision identification signs.

 

7. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

8. That the developer secure a floodplain certificate if any grading is to occur within a floodplain.

 

9. That the developer submit a street name signage plan to the Street Naming Committee for approval before the submittal of the first final plat.

 

10. That the developer dedicate public parkland for 89 single family lots in satisfaction of Section 66-128 of the Subdivision Regulations as shown on the attached preliminary

plat.

 

11. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in

front of residential lots with a copy to be submitted to the Department of City

Development. The plan shall include size, type, species, and placement of trees.

 

12. That the developer include a statement on the final plat prohibiting vehicular access from Lots 53 through 56 and Lots 73 through 75 onto N.W. Waukomis Drive.

 

13. That the developer include statement on the final plat regarding the required 50 feet landscaped buffer strip and identify the location of the buffer strip on all lots which

back onto N.W. Waukomis Drive.

 

14. That the developer dedicate additional right of way for N.W. Waukomis Drive (Line Creek Parkway) to provide a total of 200 feet of right of way for the parkway and an

additional 50 feet for the ATA rapid transit corridor (for a total of 250 feet) as

required by the Department of Public Works.

 

15. That the developer enter into a cooperative agreement with the City regarding improvement of that portion of the east half of Line Creek Parkway adjacent to

residential lots to be developed (not that portion along Tract B), to parkway standards

as required by the Department of Public Works.

 

16. That the developer improve the east half of Line Creek Parkway adjacent to Tract B to parkway standards at such time as Tract B is developed as required by the

Department of Public Works.

 

17. That the developer dedicate right of way for N. Bell Street as required by the Department of Public Works so as to provide a total of 80 feet of right of way for N.

Bell Street.

 

18. That the developer construct N. Bell Street to secondary arterial street standards as required by the Department of Public Works, including grading four lanes and paving

two lanes..

 

19. That the developer construct sidewalks on both sides of N. Bell Street as required by the Department of Public Works.

 

20. That the developer extend water mains as required by the Water Services Department.

 

21. That the developer extend sanitary sewers as required by the Department of Public Works.

 

22. That the developer construct all-weather roads and provide fire protection as required by the Fire Department prior to construction beyond footings and foundations.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 970197, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
