COMMITTEE SUBSTITUTE
FOR RESOLUTION NO. 070084, AS AMENDED
Directing the City Manager to
work with the Court En Banc of the Sixteenth Judicial Circuit Court of Missouri
Kansas City Municipal Division, the City Prosecutors Office, neighborhood
groups and other justice system partners to develop plans for the implementation
and operation of a community court supporting intensive supervised probation
services for all divisions of the Court.
WHEREAS,
Community Court emphasizes strict monitoring, community service and access to
intensive rehabilitative services addressing the underlying cause of many
repeat offenders, problems such as homelessness, drug and alcohol dependencies,
and under-employment /joblessness; and
WHEREAS, restorative justice emphasizes repairing the harm caused by
criminal behavior and paying back to the individual and society for the wrong;
and
WHEREAS, the
need for intensive rehabilitative probation services, particularly in response
to the growing drug and alcohol addiction problem in our City is well
documented and is needed for an effective community court system; and
WHEREAS, the
Judges of the Kansas City Municipal Court and the City Council recognize the
need for a program of intensive supervised probation services, increased staff
to provide such services and monitor probationers and a sufficient number of
judges to further the mission of the Court as a Community Court; NOW,
THEREFORE,
BE IT RESOLVED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the City Manager is hereby directed to establish, in cooperation with the Court
En Banc of the Sixteenth Judicial Circuit Court of Missouri, Kansas City
Municipal Division, the City Prosecutors Office, neighborhood groups and other
justice system partners as deemed appropriate, a plan for:
- developing a community court with
intensive supervision of probationers most at risk and determining how
supervised probation is supported by the citys current correctional
institute;
- assessing the need for expanded
correctional capacities in the form of a regional municipal jail;
- evaluating the need for the
proper number of judges to adequately support the community court plan.
Section 2. The
City Manager is hereby directed to provide a report to the Neighborhood
Development and Housing Committee within thirty (30) days of adoption of this
resolution so that the Council may give appropriate consideration to the plan
for the 2007-2008 Budget.
