Approving
the preliminary plat of Oakhill Village on an approximately 13.74 acre tract of
land generally bounded by the abandoned right of way of K.C.Q.& O. Railroad
on the west, N.W. 90th Street on the south, a line extending northerly from the
terminus of N. Main Street on the east, and Missouri Highway 152 on the north.

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That the preliminary plat of Oakhill Village on an approximately 13.74 acre
tract of land generally bounded by the abandoned right of way of K.C.Q.& O.
Railroad on the west, N.W. 90th Street on the south, a line extending northerly
from the terminus of N. Main Street on the east, and Missouri Highway 152 on
the north, and more specifically described as follows:
Tract 12, 13 and 14, Bigham Heights, a
subdivision of land in Kansas City, Clay County, Missouri, according to the
recorded plat thereof. (Except that part of Tract 12 taken for Missouri Route
152 right of way) and all that part of the right of way of the Chicago,
Burlington & Quincy Railroad Company located in the West One-Half of the
Southwest Quarter of Section 2, Township 51 North, Range 33 West of the Fifth
Principal Meridian, which lies on the eastwardly side of the centerline of said
right of way and abuts upon and immediately adjoins vacated Parallel Avenue,
adjacent to the land now owned by said grantee, being Lots 18 and 19, Plat of
Bigham Heights, in said West One-Half of the Southwest Quarter of Section 2,
all in Kansas City, Clay County, Missouri. Also tracts numbered 18 and 19,
Bigham Heights, a subdivision of land in Kansas City, Clay County, Missouri,
according to the recorded plat thereof.

hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly
known as the Subdivision Regulations.
2. That
the developer submit a macro/micro storm drainage study to the City Engineering
for approval prior to approval of the final plat and that the developer make
any improvements as required by the City Engineer's Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer extend water mains as required by the Water Services Department.
7. That
the developer extend sanitary sewers as required by the Department of Public
Works.
8. That
the developer construct hard surface roads and provide for fire protection as
required by the Fire Department prior to construction beyond foundations.
9. That
the developer dedicate additional right of way for N.W. Anglia Road as required
by the Department of Public Works so as to provide a total of 50 feet of right
of way for N.W. Anglia Road.
10. That
the developer dedicate additional right of way for N.W. 90th Street as required
by the Department of Public Works so as to provide a total of 25 feet of right
of way as measured from the centerline of N.W. 90th Street.
11. That
the developer dedicate right of way for N.W. 90th Place as required by the
Department of Public Works so as to provide a total of 50 feet of right of way
for N.W. 90th Place.
12. That
the developer dedicate right of way for N. Wyandotte Avenue as required by the
Department of Public Works so as to provide a total of 50 feet of right of way
for N. Wyandotte Avenue.
13. That
the developer dedicate right of way for N.W. 90th Terrace as required by the
Department of Public Works so as to provide a total of 50 feet of right of way
for N.W. 90th Terrace.
14. That
the developer improve N. W. Anglia Road across the frontages of Lots 22, 33, 35
and 36 to residential street standards in accordance with Section A-A as shown on
the preliminary plat as required by the Department of Public Works, including
construction of curb, gutter and sidewalks and installation of streetlights and
relocation of utilities.
15. That
the developer improve the north half of N. W. 90th Street along the frontages
of Lots 1 and 17-21, inclusive, to residential street standards in accordance
with Section A-A as shown on the preliminary plat as required by the Department
of Public Works, including construction of curb, gutter and sidewalks, installation
of streetlights, reconstruction of existing roadway section to meet vertical
and horizontal alignment standards and relocation of utilities.
16. That
the developer construct N.W. 90th Place to residential street standards as
required by the Department of Public Works, including construction of curb,
gutter and sidewalks, installation of streetlights, reconstruction of existing
roadway section to meet vertical and horizontal alignment standards, and
relocation of utilities.
17. That
the developer construct N. Wyandotte Avenue to residential street standards as
required by the Department of Public Works, including construction of curb,
gutter and sidewalks, installation of streetlights, reconstruction of existing
roadway section to meet vertical and horizontal alignment standards, and
relocation of utilities.
18. That
the developer construct N.W. 90th Terrace to residential street standards as
required by the Department of Public Works, including construction of curb,
gutter and sidewalks, installation of streetlights, reconstruction of existing
roadway section to meet vertical and horizontal alignment standards, and
relocation of utilities.
19. That
the developer secure a floodplain certificate if any grading is to occur within
a floodplain as required by the Department of Codes Administration.
20. That
the developer contribute $11,124.92 in lieu of parkland dedication for 44
single family lots (44 x 3.7 x .006 x $11,389.05) in satisfaction of Section
66-128 of the Subdivision Regulations at a rate of $11,389.05 per acre (2003
rate, based upon average cost per acre of parkland for five years preceding).
21. That
the developer submit a street tree planting plan as part of the final plat with
a copy to be submitted to the Department of City Development, secure the
approval of the City Forester for street trees planted on right of way in front
of residential lots, and plant the street trees in conformance with the plan
approved by the City Forester. The plan shall include size, type, species and
placement of trees or design guidelines stating this information. Further,
that the developer either install said trees within one year of the issuance of
the home certificate of occupancy or within two years of the recording of the plat
and agree to maintain and guarantee the life of the tree for a period of one
year following the installation of the tree(s) as required by the Department of
Parks and Recreation or enter into a deferral agreement for the installation,
maintenance and guarantee of the trees as required by the Department of Parks
and Recreation.
22. That
the developer submit a street name signage plan to the Street Naming Committee
for review and approval for all street names prior to the submittal of the
first final plat.
23. That
the developer receive the approval of the Missouri Department of Transportation
prior to working within any State right of way.
24. That
the City Plan Commission grant a variance to the Subdivision Regulations that
require 50 foot buffer strip for the residential lot backing onto a public
street shown
