ORDINANCE NO. 120360

 

Authorizing the City Manager to execute a Memorandum of Understanding between the City of Kansas City, Missouri, the City of Riverside, Missouri, and Platte County, Missouri, for the planning, development, and management of the Line Creek Trail; approving the Memorandum of Understanding in substantial form; and directing the City Manager to prepare any necessary agreements and ordinances for implementation of the Memorandum of Understanding so construction can begin in 30 days.

 

WHEREAS, Kansas City and Riverside, in implementation of their respective park, trail, and community development master plans, own individual contiguous tracks of land and easement rights along Line Creek in Platte County designated as future greenway trails and currently referred to as the “Line Creek Trail”; and

 

WHEREAS, the project partners, through the implementation of their respective master plans, consider it important for the park and trail projects to be properly master planned, sustainably developed, maintained, operated and opened to the public for recreational opportunities; and

 

WHEREAS, the project partners consider it important to develop partnerships to maximize resources in providing sustainable park and recreation opportunities; and

 

WHEREAS, the project partners recognize the recreational needs of the entire area and have a long history of opening their respective facilities to all citizens to meet these needs; and

 

WHEREAS, the project partners intend to cooperate with respect to the master planning, development, maintenance, and operation of these new park and trail amenities; and

 

WHEREAS, each project partner has agreed to contribute funds to the planning, development, maintenance, and operation of these new park and trail amenities; and

 

WHEREAS, Ordinance No. 120066, passed February 9, 2012, approved the allocations in the FY 2013-17 Capital Improvements Program preliminary budget and the FY 2013 Neighborhood Conservation Projects, which included $800,000.00 for the Line Creek Trail, and stated the Council's intention regarding advance funding of the FY 2013-17 Capital Improvement Program projects; and

 

WHEREAS, the project partners will share responsibilities in good faith with mutual intent for general public welfare regarding the plans heretofore set forth, the project partners consider it appropriate to memorialize certain understandings to better assure that facilities and programs developed will continue to be a sustainable and valuable resource to the community; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That, on behalf of Kansas City, the City Manager is hereby authorized to enter into and execute a Memorandum of Understanding by and between the City of Kansas City, Missouri, the City of Riverside, Missouri, and Platte County, Missouri for the planning, development, and management of the Line Creek Trail.

 

Section 2. That the Memorandum of Understanding is approved in a form substantially similar to that attached hereto.

 

Section 3. That the Mayor and Council hereby express their intent to amend existing cooperative agreements for the Line Creek Trail to implement the Memorandum of Understanding so that construction can begin in 30 days.

 

Section 4. That the City Manager is hereby directed to prepare any necessary ordinances and agreements for implementation of the Memorandum of Understanding so that construction can begin in 30 days.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
