COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 980564

 

Approving a Community Unit Project on an approximately 54.13 acre tract of land generally located north of N.E. 78th Street (proposed), approximately 500 feet west of N. Church Road extending west to N. Flintlock Road. (11661-CUP-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 54.13 acre tract of land generally located north of N.E. 78th Street (proposed), approximately 500 feet west of N. Church Road extending west to N. Flintlock Road, and more specifically described as follows:

 

Commencing at the southwest corner of the Northwest Quarter of Section 14, Township 51, Range 32, Clay County, Missouri; thence South 8918'55" East, a distance of 1247.62 feet; thence North 0121'48" East, a distance of 1232.26 feet to the point of beginning; thence continuing North 0121'48" East, a distance of 869.99 feet to a point of curvature; thence on a curve to the right having a central angle of 3553'06", a radius of 360.00 feet, for a length of 225.47 feet; thence North 3714'53" East, a distance of 921.01 feet; thence South 6156'19" East, a distance of 1354.54 feet; thence South 2803'41" West, a distance of 1346.66 feet; thence North 8922'15", a distance of 1213.38 feet to the point of beginning. Containing 54.13 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for N. Flintlock Road as required by the Department of Public Works so as to provide 50 feet of right of way as measured from the centerline of N. Flintlock Road.

 

6. That the developer improve the east half of N. Flintlock Road to primary arterial street standards as required by the Department of Public Works, including construction of median, curb, gutter, and sidewalks and installation of streetlights.

 


7. That the developer dedicate right of way as required by the Department of Public Works so as to provide a total of 60 feet of right of way for the proposed east-west street as shown on the preliminary plan.

 

8. That the developer construct the proposed east-west street to collector street standards as required by the Department of Public Works.

 

9. That the developer enter into an agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute to the North I-35/Liberty Study Corridor Improvement Fund, in the amount of $84,252.00, based upon a rate of $119.00 per residential unit.

 

10. That the developer contribute $91,159.96 in lieu of parkland dedication for 708 multi-family units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

11. That the developer secure the approval of the Board of Zoning Adjustment for any subdivision identification signage.

 

12. That the developer secure a floodplain certificate if any grading is to occur within a floodplain.

 

13. That the developer submit a street name signage plan to the Street Naming Committee for approval prior to the submittal of the first final plat.

 

14. That the developer extend water mains as required by the Water Services Department.

 

15. That the developer extend sanitary sewers as required by the Department of Public Works.

 

16. That the developer provide for fire protection as required by the Fire Department

 

17. That the developer submit a final plan for each phase to the City Plan Commission for approval. The final plans shall include plans for landscaping, lighting, grading, signage and berming and shall be in compliance with the Shoal Creek Parkway and Primary Arterial Street Design Guidelines.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 980564, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
