COMMITTEE SUBSTITUTE FOR
ORDINANCE NO. 010237
Approving
an amendment to a previously approved development plan in District GP-1 (General
Industry) on approximately a 11 acre tract of land generally located west of
N.W. Prairie View Road, extending approximately 1,400 feet south of the
intersection of N. Congress Avenue and N.W. Prairie View road and east of N.
Congress Avenue, for the purpose of deleting an approximately 7 acre tract of
land from said development plan and for the purpose of including an additional
tract of land of approximately 0.36 acres in said development plan.

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved development plan in District
GP-1 (General Industry) on approximately a 11 acre tract of land generally
located west of N.W. Prairie View Road, extending approximately 1, 400 feet
south of the intersection of N. Congress Avenue and N.W. Prairie View Road and
east of N. Congress Avenue; and more specifically described as follows:
All of Lots 1, 2, 3, 4 and 5, Swarts Industrial
Park, a subdivision of land in Kansas City, Platte County, Missouri, and all
that part of Lot 6, Sarah Glass Place, a subdivision of land in Kansas City,
Platte County, Missouri, lying easterly and adjacent to said Swarts Industrial
Park.
for
the purpose of deleting therefrom an approximately 7 acre tract of land, more
specifically described as follows:
All of Lots 4 and 5, Swarts Industrial Park, a
subdivision of land in Kansas City, Platte County, Missouri, and all that part
of Lot 6, Sarah Glass Place, a subdivision of land in Kansas City, Platte
County, Missouri, lying easterly and adjacent to said Swarts Industrial Park.

that the remaining tract of land of approximately 4 acres, more specifically
described as follows:
All of Lots 1, 2, and 3, Swarts Industrial Park,
a subdivision of land in Kansas City, Platte County, Missouri.
and together with an
additional tract of land of approximately 0.36 acres, more specifically
described as follows:
All that part of Lot 4, Sarah Glass Place, a
subdivision of land in Kansas City, Platte County, Missouri, described as
follows: Beginning at the northwest corner of said Lot 4; thence North 89E58'47" East, along the north line of
said Lot 4, a distance of 184.70 feet; thence South 00E01'13" East, a distance of 85.00
feet; thence North 89E33'45" West, a
distance of 185.37 feet to a point on the west line of Lot 4; thence North 00E26'15" East, along the west line of
said Lot 4, a distance of 83.52 feet to the point of beginning.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer make any
improvements as required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer extend water mains as required by the Water Services Department.
6. That
the developer extend sanitary sewers as required by the Department of Public
Works.
7. That
the developer dedicate additional right of way for N. Congress Avenue as
required by the Department of Public Works so as to provide a total of 40 feet
of right of way as measured from the centerline of N. Congress Avenue.
8. That
the developer improve the east half of N. Congress Avenue to secondary arterial
street standards as required by the Department of Public Works, including
construction of curb, gutter and sidewalks and installation of streetlights.
9. That
the developer grant an Aviation and Noise Easement to the City as required by
the Aviation Department.
A
copy of said development plan is on file in the office of the City Clerk under
Document No. 010237, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
