Amending Chapter 2, Code of
Ordinances, by repealing Section 2-1449 relating to the failure to obey a
municipal court summons and enacting in lieu thereof one new section of like
number and subject.
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
Chapter 2, Code of Ordinances of the City of Kansas City, Missouri, is hereby
amended by repealing Section 2-1449 relating to the failure to obey a municipal
court summons and enacting in lieu thereof one new section of like number and
subject, to read as follows:
Sec. 2-1449. Failure to obey
summons; dismissal of charges.
(a) Any person
who shall be duly served with a summons issued by the court or by any officer
authorized to issue a summons and who shall fail or refuse to obey any of its
terms and conditions, or who shall fail to appear at the place and at the time
fixed therein, may be punished by a fine of not less than $10.00 and not more
than $500.00.
(b) No
prosecution shall continue on any charge of violating any ordinance when the
charge is brought against a person who fails to appear in court on such charge
unless the charge alleges the person committed a violent act. The term
“violent act” for the purposes of this section shall mean causing personal
injury or property damage, operating a motor vehicle while intoxicated or under
the influence of intoxicants or drugs, operating a vehicle with a
counterfeited, altered, suspended or revoked license or feeling or attempting
to elude a law enforcement officer.
(c) The
provisions of Chapter 2 regarding the satisfaction of municipal court judgments
not subject to subsection (b) of this section and the execution of such
judgments by fine shall be reviewed by City staff for the purpose of having a
just, fair and equitable civil collections process for the collection of fines
upon judgments not subject to said subsection (b) and following such review
shall make a report of findings to the Council.
