ORDINANCE NO. 900737
Approving an amendment to a previously approved
preliminary plan in District R-4-p on a 0.88 acre tract of land located on the
east side of Logan Road approximately 500 feet south of U.S. Highway 40 by deleting
therefrom a certain portion of such land. (9513-P/6)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved preliminary plan in District R-4-p on a 0.88 acre tract of land
located on the east side of Logan Avenue approximately 500 feet south of U.S.
Highway 40, and more specifically described as follows:
All that part of the SW 1/4 of Section 25, Township
49, Range 32, Kansas City, Jackson County, Missouri, more particularly
described as follows: Commencing at the Northwest corner of the SW 1/4 of
said Section 25; thence S 206'33" W, along the West line of the SW
1/4 of said Section 25, a distance of 548.19 feet, to the true point
of beginning of subject tract; thence continuing S 206'33" W, along
the West line of the SW 1/4 of said Section 25, a distance of 169 feet;
thence S 8709'12" E, a distance of 225 feet; thence N 206'33"
E, a distance of 169 feet; thence N 8709'12" W, a distance of
225 feet, to the true point of beginning of subject tract, all
subject to that part thereof dedicated for street purposes.
is hereby amended by deleting a portion thereof so that
the amended district is more specifically described as follows:
All that part of the Southwest Quarter of Section
25, Township 49, Range 32, Kansas City, Jackson County, Missouri,
being more specifically described as follows:
Commencing at the Northwest corner of said
Southwest Quarter; thence South 205'22" West (South 206'33"
West, Deed) along the West line of said Southwest Quarter, a distance
of 548.19 feet to the point of beginning of the tract of land to be herein
described; thence continuing South 205'22" West (South 206'33"
West, Deed) along said West line, 169 feet; thence South 8710'23"
East (South 8709'12" East, Deed), 225 feet; thence North
205'22" East and parallel with the West line of said Southwest Quarter,
a distance of 169 feet; thence North 8710'23" West (North
8709'12" West, Deed), 225 feet to the point of beginning. Less and
except the North 29 feet thereof and that part now in road.
and approving in lieu thereof an amended preliminary
plan, subject to the following conditions:
1. That the developer dedicate 25 feet of right of
way from centerline of Logan Road and construct a half street
improvement to Logan Road to meet current City
standards
for residential streets.
2. That the developer cause the area to be platted
and processed in accordance with Chapter 31, Code of General
Ordinances, as amended, commonly known as the
Subdivision
Regulations.
3. That the developer extend water mains and
dedicate required easements in accordance with current City
standards and regulations.
A copy of said amended preliminary plan is on file
in the office of the City Clerk under Document No. 900737, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
