COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 070581

 

Devoting to public use a portion of City owned property adjacent to 22nd Street between Gillham Road and Holmes Road; and directing the City Clerk to record this ordinance.

WHEREAS, a portion of property adjacent to 22nd Street between Gillham Road and Holmes Road and owned by the City is needed as right of way for street improvements associated with the 22nd Street Corridor and as shown on plans filed in the Office of the Director of Public Works; and

WHEREAS, the City devotes a portion thereof for public purposes as part of said street improvement; and

WHEREAS, this ordinance changes Tract 100 to Parks and Recreation Tract 3A, with property description changing accordingly; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City hereby devotes a portion of the property for public purposes as part of the 22nd Street Corridor improvement shown as Tracts, 103, 115, 117, and Parks and Recreation Tract 3A legally described as follows:

Tract 103: A tract of land for the purpose of public road right-of-way being a part of Lots 11, 25 and 26 in Col. E.M. McGees Subdivision, and the vacated alley between said lots, a subdivision in the Northeast Quarter (NE ) of Section 8, Township 49, Range 33 in Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the East Quarter Corner of said Section 8; thence North 02 degrees 42 minutes 55 seconds East, a distance of 452.15 feet perpendicular to the proposed centerline of 22nd Street; thence North 87 degrees 17 minutes 05 seconds West along said centerline, a distance of 1,157.64 feet; thence North 87 degrees 50 minutes 48 Seconds West along said centerline, a distance of 371.01 feet; thence North 87 degrees 15 minutes 32 seconds West along said centerline, a distance of 136.43 feet; thence South 02 degrees 44 minutes 28 seconds West, a distance of 34.98 feet to the true point of beginning; thence North 87 degrees 11 minuets 15 seconds West, a distance of 449.95 feet; thence North 02 degrees 48 minutes 45 seconds East, a distance of 60.00 feet; thence South 87 degrees 11 minutes 15 seconds East, a distance of 449.95 feet; thence South 02 degrees 48 minutes 45 seconds West, a distance of 60.00 feet to the point of beginning. The above described tract of land contains 26,997.00 square feet, more or less.

Tract 115: A tract of land for the purpose of public road right-of-way being a part of Lot 14 and 15 of Block 7, Elm Grove Addition, a subdivision in Northeast Quarter (NE 1/4) of Section 8, Township 49, Range 33 in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the East Quarter (E ) Corner of Section 8, thence North 02 degrees 42 minutes 55 seconds East, a distance of 452.15 feet; thence North 87 degrees 17 minutes 05 seconds West, a distance of 567.58 feet; thence North 02 degrees 42 minutes 55 seconds East, a distance of 20.00 feet to the southeast corner of Lot 15 as the point of beginning; thence North 87 degrees 15 minutes 03 seconds West along south line, a distance of 160.00 feet to a point on the southwest corner of said lot; thence North 02 degrees 23 minutes 59 seconds East along the west line of Lots 15 and 14, a distance of 35.00 feet; thence South 87 degrees 15 minutes 03 seconds East along a line parallel to the south line, a distance of 160.00 feet to a point on the east line of Lot 14; thence South 02 degrees 23 minutes 59 seconds West along the east line of Lots 14 and 15, a distance of 35.00 feet to the point of beginning. The above described tract of land contains 5,600.53 square feet, more or less.

Tract 117: A tract of land for the purpose of public road right-of-way being part of Lots 16-17 inclusive of Elm Grove Addition, a subdivision in the Northeast Quarter (NE ) of Section 8, Township 49, Range 33 in Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the East Quarter Corner of Section 8; thence North 02 degrees 42 minutes 55 seconds East, a distance of 452.15 feet perpendicular to the proposed centerline of 22nd Street; thence North 87 degrees 17 minutes 05 seconds West along said centerline, a distance of 392.91 feet; thence North 02 degrees 42 minutes 55 seconds East, a distance of 19.89 feet to the southeast corner of said Lot 16 as the point of beginning; thence North 87 degrees 15 minutes 03 seconds West along the south line thereof, a distance of 159.68 feet to a point on the southwest corner of said lot; thence North 02 degrees 23 minutes 59 seconds East along the west line of said Lots 16-17 inclusive, a distance of 35.00 feet; thence South 87 degrees 15 minutes 03 seconds East along a line parallel to the south line of said Lot 16, a distance of 159.68 feet to a point on the east line of said Lot 17; thence South 02 degrees 23 minutes 59 seconds West along the east line of Lots 17-16 inclusive, a distance of 35.00 feet to the point of beginning. The above described tract of land contains 5,589.38 square feet, more or less.

Parks and Recreation Tract 3A

A tract of land for the purpose of public road right-of-way being a part of Lots 20 through 25 inclusive in Gallfys Addition, and Lots 11, and 25 in Col. E.M. McGees Subdivision, and the vacated alley between said lots, subdivisions in the Northeast Quarter (NE1/4) of Section 8, Township 49, Range 33 in Kansas City, Jackson County, Missouri more particularly described as follows:

Commencing at the East Quarter Corner of said Section 8; thence North 02 degrees 42 minutes 55 seconds East, a distance of 452.15 feet perpendicular to the proposed centerline of 22nd Street; thence North 87 degrees 17 minutes 05 seconds West along said centerline, a distance of 1157.64 feet; thence North 87 degrees 50 minutes 48 seconds West 371.01 feet; thence North 87 degrees 15 minutes 32 seconds West along said centerline, a distance of 336.35 feet; thence North 02 degrees 44 minutes 28 seconds East, a distance of 25.27 feet to the true point of beginning; thence North 0 degrees 01 minutes 04 seconds East, a distance of 15.00 feet; thence North 85 degrees 33 minutes 10 seconds West, a distance of 464.12 feet; thence South 27 degrees 29 minutes 00 seconds East, a distance of 51.18 feet; thence South 89 degrees 26 minutes 45 seconds East, a distance of 441.00 feet to the point of beginning. Said tract contains 13,957.47 square feet, more or less.

Section 2. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Kansas City, Jackson County, Missouri
