COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 150200

 

Declaring certain real property known as Kemper Arena, located at 1800 W. 23rd Street, surplus to the City’s needs; directing the City Manager to issue a request for proposals for the redevelopment or reuse of the existing facility and/or site; and authorizing the City Manager to offer for sale the City’s interest in this property.

 

WHEREAS, the City owns rights in certain real property located at 1800 W. 23rd Street; and

 

WHEREAS, all City Departments have been notified and this property is not needed by the City and no interest has been expressed in retaining the land and the existing facility and/or site for future public use; and

 

WHEREAS, while the City has an obligation to maintain Kemper Arena until April 15, 2016 at which time the Kansas City Municipal Assistance Corporation (KCMAC) Series 2006B Bonds will be fully defeased, it is in the best interest of the City to move forward with proposals for future development of the site at this time; and

 

WHEREAS, the property will be surveyed and a legal description prepared upon selection and approval of a development project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the parcel generally depicted in Exhibit A, attached hereto, located at 1800 W. 23rd Street, including Kemper Arena which is located on said parcel, is hereby declared surplus to the City’s needs.

 

Section 2. That the City Manager is directed to issue a nationally advertised request for proposals, seeking development partners and development proposals for the redevelopment or reuse of Kemper Arena, and/or its site, to identify a feasible and desirable reuse of the property which will divest the City of its obligation to operate and maintain the facility, but only upon retirement of the KCMAC Series 2006B bonds.

 

Section 3. That contingent upon the selection and approval of a development entity and project, the City Manager, subject to Council approval, is hereby authorized to offer and sell in accord with City regulations, the City’s rights in the property located at 1800 W. 23rd Street, Kansas City, Jackson County, Missouri.

 


 

Section 4. That subject to the limitations outlined above, the City Manager is hereby authorized to execute any real estate or other documents needed to effectuate the transaction noted herein.
