ORDINANCE NO. 060332

 

Rezoning an area of about 0.68 acres generally located at the southeast corner of 29th Street and Cherry Street from District R-2b to District URD, and approving a development plan for the same. (8401-URD-14)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0666, rezoning an area of approximately 0.68 acres generally located at the southeast corner of 29th Street and Cherry Street from District R-2b (Two-Family Dwellings) to District URD (Urban Redevelopment District), and approving a development plan for the same, said section to read as follows:

Section 80-11A0666. That an area legally described as:

Lots 40, 41, 42, 43, 44, 45, 46, 47 and 48, Block 2, Coleman Place, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby rezoned from District R-2b (Two-Family Dwellings) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0666, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

1. That the developer cause the area to be platted and processed according to Chapter 66, Code of General Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro/micro storm drainage study to Development Services for approval for the entire development when the first plat is submitted, and that the developer construct any improvements as required by Development Services.

 

3. That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, alleys, storm sewers, and streetlights as necessary along all development frontages, as required by Development Services, prior to recording the plat.

 

4. That a 6 foot variance to the minimum required right-of-way width of 31 feet as measured from centerline for a residential street so as to permit 25 feet of right-of-way as measured from centerline and as shown on the development plan is hereby granted.

 

5. That the development plans show the retaining wall and stairs pulled back out of the right-of-way or that developer obtain an encroachment permit for these structures prior to issuance of permits for construction.

 

6. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

7. That the developer extend sanitary sewers to ensure individual service and determine adequacy as required by Development Services.

 

8. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of the full width alleyway at the proposed expansion onto private property.

 

9. That the developer provide for fire protection as required by the Fire Department.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted in the right-of-way in front of residential lots, with a final approved copy to be submitted to the City Development Department staff. The plan shall include size, type, species and placement of trees or design guidelines stating this information. Further, that the developer either install said trees within one year of the issuance of the home certificate of occupancy or within two (2) years of the recording of the plat, whichever occurs first, and agree to maintain and guarantee the life of the tree for a period of one year following the installation of the trees as required by the Department of Parks and Recreation or obtain a performance bond for the installation, maintenance and guarantee of the trees.

 

12. That the developer contribute $1,793.10 in lieu of parkland dedication based on 15 MF units x 2 persons/unit x 0.006 acres/person x $9,961.61/acre = $1,793.10 as required by Section 66-128 of the Subdivision Regulations.

 

13. That the developer submit a site plan to the Director of the Department of City Development for approval prior to the issuance of a building permit. The site plan shall include information regarding: property uses, setback distances, lighting, landscaping and architectural characteristics, berms, trees and plantings around and within the parking lots; show proposed pedestrian circulation; and include elevation drawings of buildings and signage.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
