COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 110874

 

Authorizing the Director of Public Works to enter into a Cooperative Agreement with the Missouri Department of Transportation for the transfer of City funds as local match for a Transportation Enhancement grant for construction of M-150 Trail from the terminus of Botts Road and NNSA project west to Prospect Avenue; and recognizing an emergency.

 

WHEREAS, the Citywide trails plan calls for the Missouri Route 150 trail to extend from Botts Road to Blue River; and

 

WHEREAS, the NNSA project under construction at Missouri Route 150 and Botts Road is constructing portions of the Missouri Route 150 trail; and

 

WHEREAS, the Citywide trails plan calls for the Missouri Route 150 trail to extend from Botts Road to Blue River; and

 

WHEREAS, MoDOT in cooperation with Kansas City Southern Railroad will be  constructing a new Thunderbird Road interchange over M-150 west of Botts Road starting in 2012; and

 

WHEREAS, the City has received a $468,750.00 grant to fund the construction of the Route 150 trail from Thunderbird Road to Prospect Avenue from the Federal Transportation Enhancement program which requires a local match of $212,500.00; and

 

WHEREAS, the trail grant will construct 2,809 feet of 10' wide concrete trail along Route 150 and will continue the trail currently under construction as part of NNSA project on Botts Road and will provide a missing link in trail improvements planned to extend from the Blue River to M-291; and

 

WHEREAS, substantial cost savings can be achieved constructing the trail in combination with the Thunderbird interchange project being bid by MoDOT; and

 

WHEREAS, MoDOT has accelerated their project schedule to enable a construction notice to proceed in March 2012 and consequently payment of City funds is due by mid-November in order to retain the project schedule; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is hereby authorized to execute, on behalf of Kansas City, a Cost Apportionment Cooperative Agreement with the Missouri Highways and Transportation Commission for the transfer of City funds as local match for a Federal Transportation Enhancement grant for construction of M-150 Trail from the terminus of Botts Road and NNSA project west to Prospect Avenue. A copy of this Cooperative Agreement is on file in the office of the Director of Public Works.

 

Section 2. That the Director of Public Works is authorized to expend $212,500.00 from funds previously appropriated to the following account:

 

12-3090-898607-B-89020164 M-150 Trail – Prospect to NNSA $212,500.00

 

Section 3. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it relates to a public improvement, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
